seriously,get yer self down to citazens advice,they'll put you in touch with legal people who'll love to get their teeth into your 'boss' as he sounds a bit of a pratt. are you union at your place of work? if so,join pronto and they'll represent you as part of yer union subs.

Unfortunately I don't think the union will help in this case as the incident occurred prior to joining.

Do you have proof of requesting these pens at earlier dates? If so he will have no leg to stand on as far as I can see. If not, what about witnesses that are willing to back you up? (I suspect the latter will be a bit more difficult)

ive admitted f**king the job up what am saying is how the  procedures work for dismissal i.e verbal, written, final written, gone

yeah my mate whos my superviser has said about the treater pens etc

What I'm getting at is that if you have proof that you have previously asked for the pens and your boss decides to sack to giv you the heave ho then you will have a better case for unfair dismissal.

Sacked

Although gross miscounduct is instant dismissal, but that is more for violent attacks, sexual harrassment that kind of thing. I think any company would hard pushed to get you on gross misconduct for what you did.

Unfortunately not. If you cock up a big job and cost the company alot of money through your own negligence, that is gross misconduct.
They will probably have to prove negligence on your part.

everyone makes mistakes at work, were only human, i cost my old company £40k in one hour, did get a written for it though :sad: theres always someone else you work with that will get away with more for less punishment

i guess it depends how much they want you out, if youve been there a long time, the bigger the pay packet they would have to give you when you leave

eg. i was at my old company 3 yrs, i got £3k and a good bye youre no longer needed, a guy at were i work now left after 14 yrs, he picked up around £40k i believe

That wouldn't happen here, but i do work for a huge company Saint-Gobain. I could understand if you were acting dangerously when the cock up happened then yes gross misconduct but people make mistakes. I would say you would struggle to get gross misconduct for a one off error, especially as he wasnt equipped to do the job correctly.
