.......but the account of any witnesses may also go for/against you (eg speed/driving style/traffic flow etc).
 

The witnesses cant be for sure what speed i was going. Plus they have no evidence to support it. Its not FACT and therefore cant be persued as a line of action i would have thought......
I was less than a 100yds from the interchange and therefore was naturally slowing down.

 :angry: old git  :angry: NOT you maxamus  :wink: i know the road well i have used it a lot in the past and about 2 years ago i very nearly had the same accident but a little way back just before the garage, as the driver decided to go from the left hand lane and come into my lane on the right without indicating at all. i managed to brake just in time to miss his back end and i ended up swerving over the road and over the grass verge into the garage , and by the time i composed myself and started to drive off he had gone. :angry:

Good answer, but opinions or/or experience do count. I've re-read your original post and now realise you were approaching the roundabout and not actually on it turning right. Shouldn't happen, but you may well find this goes 50/50.

Stick with it and good luck with the claim though.

Here's another example that happened to my brother-in-law:-

On a roundabout turning to the third exit and whack!!!

Old biddy in a Yaris hits him coming out of the second road

Old biddies wife in the passenger seat gets out of the car and literally starts screaming at him that it is his fault and he should accept responsibility.

Old biddy driver gets out and does similar.

BIL says he was on the roundabout and naturally has the right of way.

OB says that there was a set of traffic lights just before the roundabout that were on green and therefore he had the right of way.

BIL states that the lights are for the crossing and lights aren't valid for a roundabout as there are no lights actually on the roundabout (which there weren't)

Accident happened 100yards from Police station

OB says they should visit police station

Both visit police station and Police explain that old biddie is in the wrong

OB's wife screams at hubby and leave stage left :grin:

The point really is that although people think they are in the right they sometimes aren't and so the person who hit you will swear blind that they are in the right when they aren't :smiley:

I will be p1ssed off if it does go 50/50 because clearly it was not my fault! The TP should have looked to see if there was a car on his right before he moved over. Clearly if he had he would have stayed in his lane. His point that i was speeding would clearly mean that he MUST have seen me in the other lane but still decided to go into me.

1. He didnt see me and moved into my lane and WHAM!
2. He did see me but still decided to move into my lane and WHAM!


I guess he's gonner go down the line of "he was speeding" which i assume he will because his witnesses will support his case (with no evidence), would indicate that he did see me which would mean careless driving on his part.

His witness, the old fooker, was on the opposite side of the dual carriageway and just came off the interchange so he would have had no inkling to what speed i was doing. Its not like i shot past him.
Im suprised he would have seen the accident at all because all he would have seen is my driverside.

As far as im concerned i would say its clear cut and so would my insurer because "drive assist" will be dropping off a nice like-for-like or equivilant car, on monday paid out of TP's policy  :wink:

Ohhhhhhhhhhh i forgot to mention, he was so pedantic that he rang his insurer there and then and said his vehicle needs towing away because it is undriveable!!! Man i see cars all the time on the roads with a wing mirror missing! What a loon  :sick:

screw the beggar for lost of earnings,whiplass and anything else, oh yes driving a peice of sh!te called a peugeot ! :wink:

Sorry for your grief Max,as from what i have read and seen the photo's,i think you should make sure it does'nt go 50/50 as the guy knows he is at fault and trying to get out of it.Slightly under or over speed limit,still does'nt give him the right to pull into the r/h/lane without due care and attention.Also,what the f**k was the old C**t doing, watching what cars on the other side of Dual/car way were doing???? have him aswell !!!

In the photo's,cannot see much of the grass,but would you not think that,if you were going at crazy speeds and you get hit,knocking you into the grass verge etc,the natural reaction is to brake thus causing long marks in the green stuff ???

I know its a small heap of sh!t,but still enough force to knock a car going in a straight line to go over to the right kerb and grass!!!

Case closed,get 4 new Monzas,r/h/side kerb dam,l/h/side peugeot damage,and take him for all you can.

Yes you are right.
When he hit me i braked and swerved onto the grassed central reservation. This took a chunk out the driver side tyre wall and fooked up the alloy but i still stopped within a few metres. If i was going at excessive speeds i would have skidded for ages on the grass (as it was damp from rain earlier on). I would have ended up more nearer the interchange.

Have a look at the pics below:




My car is clearly visible parked behind his. If i was speeding then this would not be the case. The reason for that is because i would have had a longer stopping distance, particularly on the damp grass, and the car would have come to a halt much much later than his. And if this had happened, he would have pulled onto the grassed area behind mine. But what happened was we stopped side by side and he had to pull onto the grass infront of me.

Yep, new monza's all round. I wouldnt and havent normally done this because people have been honest but this guy im going to do over. The whiplash claims are going in !
