rejecting a GTI
« on: 05 November 2014, 20:56 »
ok, have had 5 breakdowns in the last 2months with my year old GTi. (at the end of Oct.. the critical problems started at 11months, but breakdowns started at 6months) all recent 3 breakdowns have been down to a misfire caused by either a stuck injector or faulty ignition coil. The last breakdown, was caused by a stuck fuel pump and on inspection at the dealers, metal filling were found in the fuel tank (probably from the fuel pump) which has also caused an injector to be stuck open. I was left 150miles from home and the car broke down on the motorway.. whole day ruined.

I do not want this car back (it is on PCP) and I have been told if I want a new car (I will have to pay a contribution.. which is to be disclosed fully)

any thoughts?

Ultimately I have made it clear I want to hand the car back and have my initial advance payment credited to my account.

shocked as this is my 3rd GTI.

I have never done it with a new car before but have had issues before with a used car.

Get some legal advice from Citizens Advice or check your home insurance you probably have free legal protection, I sued a garage before and won using my home insurance legal cover.

I would put into writing what it is you want and give them a deadline to resolve the situation also tell them you have sought legal advice.

it is a poker game, if they think you are serious and that you will sue them then there is a good chance they will back down.

Good luck!

Chris

From this statement it seems that they are already willing to discuss you rejecting the car?

It is fair that you pay a contribution as you have had use out of the car for 12 months, however, it should reflect the hassle you've had with the current one. The key thing is to negotiate that contribution down to what you think is reasonable. Obviously, I don't know the situation in any detail but there must be a position that will satisfy you...

There is another option, ask them to source you another year old example on the same terms on you're on now with no contribution...

Seeking legal advice is a reasonable step, at least you will understand where you stand...

The problem with that is you won't know what the car has done or where it's been, plus it will have 1 or 2 formers keepers on the log book.
Red Mk6 gone replaced with a white Mk7 which has gone too. Green Mk2 here to stay.

the frustrating thing is: I like the car.

however, it's been unreliable and all I want is the old car back (without issues) but with fillings in the fuel system its possibly never going to be the same, and there will be a ? over reliability in the future.

yep, VWUK and dealer admit it's not right, but the options they are offering me are rubbish. I don't want to fork out for any new car, indeed I don't want a new car unless it was a swap out (which given the language used, I know they are not going to support that.. without a substantial payment from me).

so that only leaves, handing the car back,  and loosing money

or waiting for it to be fixed and the reliability ??'s

I have CAB advice, so VW finance know about this now... quoting 2 weeks to even get a case manager onto this. meantime I am paying for a car that is sitting at the dealer broken.

I will just have to wait out and go the legal route, which I know will favour me to have my initial pcp advance payment back and a compensatory amount of monthly payments (the last few months where the car has been in the garage)

What's fair for contribution is debateable. For me i'd be happy to cover £250 depreciation for every month it didn't pay a visit to the dealership to warranty work, and get all my payments back.
Whey ya bugger! It's finally arrived after an 8 month wait....

Im happy to walk away from £4000 pounds worth of payments, all I want to be is in the same position i was a year ago and write this off and a bad car experience, my mk6 was faultless. So, VW finance take the car and then credit me with my initial deposit, allowing me to go off and by a new car. Surely that is more than fair!

That's not insurmountable... Given another thread on here, you don't know what they been doing to your car before you it is delivered new!

As for the number of former keepers issue... compensation..?

It was a suggestion the OP will have an idea what is right for him... then he will need to negotiate with the dealer to come to a compromise...
