Crashed my car - couple of questions
« on: 14 January 2012, 15:43 »
If I buy my car back off the insurance if it's a write off will I still have to pay my excess?

Also if the guy in front of me slammed on for no reason apart from he 'thought I was too close' and I went into the back of him is that still my fault? I'm guessing yes as I should have been further back.

Have you got proof of him saying that in a statement?

Why did he slam on?  Was he brake testing you because in his opinion "you were too close"?  Or was he approaching a braking point on the road / slowing down for a junction etc...

If he deliberately slammed on then he is guilty of causing an accident and you should report it to the police immediately.

DO NOT admit liability for anything in your statement to your insurance company.

Oh!!!! I assume the old bill attended? Find out what he officially said. If he did say he slammed his breaks on because he thought you were too close, you might have a bit of an argument, he's kind of admitting he caused the accident? I don't know...

In that case, you must report it to the Police.  This will help you should your insurance and his insurance start pi55ing you about.

Regardless of how close or far you were from the back of his car, he wilfully and deliberately caused a road traffic accident.  Plod don't look kindly on these things.

I hope you took some pictures of the incident and his car?  This should demonstrate that he was not slowing down for a junction etc.. and support your contention that he was brake testing you.

yes, but if he did say that hell change his story very soon no doubt.

sorry bud but insurance look at rear enders as, 90% of the time the guy behinds fault. as you said, you shoiuld of been further back. thats how its going to be seen, its basically always the person behinds fault

My landlord who worked in insurance claims told me that the insurance of the last person to crash is responsible for everything in front of him. but if he did a slam on for no reason you and everyone else involved can claim from his insurance.
