Can you not do an admin job within the company?

on sick they offer nothing, back at work next week on the road, cant afford to be on sick any longer.

i dont wanna sue him, like i said in my first post, was asking to see if anyone knew if theres any insurance that my workplace should have, liability or otherwise.

this is my second in 2 years, last year some twit in a white van smashed me astra up, i had bad shoulder and my lass has bad back still, were a couple of cripples, lol

My back is hurting too.

I think we should have a massage club.

You hit the guy with the front of your bus, so momentum carries you forward, even if you slammed on the brakes. 

Now, you would have to be going at a fair lick of pace, or have massive brakes and a dead stop to be thrown forward and then back into your seat from the resistance of the seat belt.  You were wearing a seat belt?

They would have a completed risk assessment for drivers and driving position etc..  Ask to see this.

You would / should have also signed a form indicating that you have received the correct training in "how to drive a bus" and set up the correct driving position etc..

I can't give a specific answer without seeing these, but from the H&S Management course I completed 2 months ago, I can say with confidence that:

Your company is not liable.

soft tissue damage, ie whiplash, but its concentrated on my back due to the design of the seat. i was doing 28mph so not speeding, but hitting someone in a bus is totally different to a car, people on bus who didnt see the accident thought that id hit a car, it is truly that bad. momentum may carry the bus forward but the drivers cab is a frame, i was all tensed up for collision and felt the force of it.

it was a new bus as well, the brakes on these are extremely powerful, disc brakes all round with pneumatic cylinders, you do the math.

risk assessment isnt needed for driving a bus, its passed vosa tests so its road legal. psv's dont have seat belts.

and yes i know my company is not liable, but employers insurance? i know car drivers can get extra accident coverage
