Was gonna make a new post but this one is so long now deserves an ending to the story 

  We Won !!!! judge has looked at the file and decided he has no defence, weather he knew it was stolen or not is irrelevant as the law states you must know what your selling, therefore he has been given a ccj to pay me the full ammount plus court fees whoooop!!
fingers crossed he pays up in 1 go , we managed to avoid the long journey to nottingham court aswell result !
