need some advice from someone in the know, hoping someone on here knows if i can do anything
this was an accident at work, im a bus driver, about 2 month ago a pedestrian walked in front of my bus, was a bad one but thankfully not fatal, full investigation by work and police and i was found 100% not at fault.
but now my questons, i have been on sick for 5 weeks with bad back cos of it, no head rest on seat so my back took the hit. but now work have said its an accident but they werent at fault so there not paying me all my wages, spoke to union and they basically said the same as management.
i still see it as an accident at work and surely i should be full pay, but would i have any joy with ringing a solicitor? in the back of my mind i know the only way theyll do it is by taking the pedestrian to court, but he looked like a foreign student and i could bet that even if i won in court he would just leave the country.
anyone got any advice?

What does your contract say about sick pay? If you're on sick leave, the min should be statutory sick pay which may be less than your weekly income.
Get your contract and speak to citizens advice bureau, ACAS and look at the direct.gov.uk website.

contract is for 70% pay, ive been on ssp but didnt notice cos my money just stays in bank for bills. luckily i had extra to cover. union said contract is worded so i get sick pay if company is at fault or an insured 3rd party
i rang cab and they said i can go through uninsured driver policy, then i reminded him it was a pedestrian and he said i can sue him but will incur court costs and not guarantee any return.
whats acas?

i do agree, slightly, his stupidity was the cause, couldnt wait 2 mins for a crossing. but i dont wanna sue him as it was very serious, i thought he was dead when i saw him, never regained conciousness that day afaik. I know he didnt do it on purpose as he tried to run at the last second and the force of the collision was very horrific, i wouldnt wish it on anyone

nope, head rest are really there for getting rear ended, doesnt usually apply to a bus, but when i went on brakes i lifted my arse off the seat and had pedal to floor, my back arched over the seat and caused the shock when i hit him, still cant sleep properly after 2 months!

Even though we don't really know what happened, only what we've been told, if someone has caused an accident, then they are responsible. It's not just vehicle drivers that should take responsibility.

on sick they offer nothing, back at work next week on the road, cant afford to be on sick any longer.

You hit the guy with the front of your bus, so momentum carries you forward, even if you slammed on the brakes.
Now, you would have to be going at a fair lick of pace, or have massive brakes and a dead stop to be thrown forward and then back into your seat from the resistance of the seat belt. You were wearing a seat belt?
They would have a completed risk assessment for drivers and driving position etc.. Ask to see this.
You would / should have also signed a form indicating that you have received the correct training in "how to drive a bus" and set up the correct driving position etc..
I can't give a specific answer without seeing these, but from the H&S Management course I completed 2 months ago, I can say with confidence that:
Your company is not liable.

soft tissue damage, ie whiplash, but its concentrated on my back due to the design of the seat. i was doing 28mph so not speeding, but hitting someone in a bus is totally different to a car, people on bus who didnt see the accident thought that id hit a car, it is truly that bad. momentum may carry the bus forward but the drivers cab is a frame, i was all tensed up for collision and felt the force of it.
it was a new bus as well, the brakes on these are extremely powerful, disc brakes all round with pneumatic cylinders, you do the math.
risk assessment isnt needed for driving a bus, its passed vosa tests so its road legal. psv's dont have seat belts.
"how to drive a bus" you mean my driving test?
and yes i know my company is not liable, but employers insurance? i know car drivers can get extra accident coverage

Your bus company will have liability Insurance but the clue is in the name. They will only pay out if the Company is liable. As they are not, there is nothing the insurers are required to pay for.
remember, insurance is only there to protect you against incidents that you are liable for (like your car / home insurance)
The only thing you could claim from is if you have any Indemnity Insurance covering yourself in the event of being unemployed/incapacitated. This is sometimes sold as part of your mortgage or credit card PPI so check there if you are eligible.

hit someone in a car and the pedestrian goes over the top, a bus is flat faced and the impact is severe. in the cctv you can see him going about 6 inchs into the winscreen. plus i was lifted out of the seat whilst i was braking. but honestly whiplash can come from the slightest knock, a driver at my place was on sick cos his drivers seat dropped and he got whiplash.
elvi whats your point? you were in a car with a seatbelt and hit a crumple zone in a car thats designed to disperse the energy, buses arent designed like that, the only safety tests ran on buses is for safety of passengers. were you tensed ready for impact?

I would leave it. Why would you say it needs a head rest. If you hit someone (bus vs human) how you hurt your back. If you brake hard you go forwards not like you got shunted from behind. Dont sue the bloke . If he was messing around he wont do that again. Last job i had ,a bloke took half a year off on full pay ,every year for stress. I had to cover him with a bad back and dislocated arm. I crashed a bike at full speed. I never go to doctors. Just use it and it gets better. After work ( lifting 25kg bags and plaster boards) i had a bad pain in my back i had to crall out of my car and lay on my bed. Took me, 2 weeks before back got better , my arms still f@@k after 5+ years. Ill live with it. :undecided: I cant knock you. Iv seen the lightest tap from behind .2 cars pulling away from traffic lights .1 women got airlifted away by chooper, then the other collapsed after her mum was airlifted away with ,neck pains.

Use your back dont lay in bed. I did a first aid course in my new job. Im not saying goto work like i did. God that was a bad pain / if i tryed running i swear i would of passed out. :wink:

Yeah moving about is really helping,only problem about my job is sittng driving makes it worse, but with being off work I've had time for gym. Can do weightsbut treadmill really hurts, must be the impact
not sueing the bloke, never said I was, was just saying that's what people told me was my only option.
Dont think they need head rests, just higher back seats, when i was braking hard i had my back over the top of the seat, wouldn't have happened if the seat was higher.

My missus does Krav Maga and she got whiplash when she was thrown to the ground onto a mat
Don't forget that your seat and the vehicle are designed to minimise injuries.......hence crumple zones, seat belt tensioners and head rests

She really enjoys it mind and some of the stuff they teach her is :shocked: :shocked:

That's not bad. Some of the internet prices quoted on their websites is mad.
It's pretty lethal stuff, it's used by the Israeli Special Forces.
Essentially alot of it is similar to ju jitsu.
I pay about £10 a week and get 4 hours training, but i also get extra training most weeks at mine as well.
The problem with most martial arts is it's all about making money. My club is certainly an exception.

From what I've seen and had demonstrated (lol) it's basically no rules self defence with the aim to inflict as much damage before running, so either kick them in the sensitive areas, gouge their eyes out etc etc :evil:
I've thought about doing it myself as I'm crap at sticking at to going to the gym :sad:

Why not give it a try?
I changed from shotokan to wado for the ju jutsu, i'm looking at wing chun now as well.
A friend i met through Sensei is an expert in Wing Chun, i've done a couple of private sessions already.
In the summer i'll probably do that as well, so training 4 times a week.
Plus i want to be the Ip man :laugh:
