Is this an mot fail...?

In the rear arch on off side above and to the side of where the fuel filler neck goes through the inner skin there is some rusty holes Is this going to be an mot fail or is the inner skin a non structural part?

Depends how close it is to the suspension turret - rules are as follows:

Corrosion

A vehicle can fail with respect to corrosion for:

excessive corrosion in a 'prescribed area' — within 30 cms of certain safety related components, e.g. brakes, steering, suspension, seat belt mountings etc.
excessive corrosion not in a 'prescribed area', but which is likely to adversely affect the vehicle's braking or steering. 'Excessive corrosion' can mean a hole or a significantly weakened structure.

- NB mine had a whole in a similar area and it passed fine.

Yeah I knew it was something like that and unfortunately it is defo within 30cms of the rear suspension turret However, it must have been like that for a couple of years at least and its passed the last mots ok. Will have to stick it through and hope for the best...if it fails it's scrap as I can't be bothered to try and weld that back up. Damn annoying too as just spent the last 3 days welding up the sills etc so if it fails now I'll be gutted. Thanks for the reply

Apart from being up in the top of the arch and has a fuel filler neck/fuel tank in the way. If I remove that then I'll no doubt have to replace all the fuel lines as they wont come undone then theres the issue that if I'm doing that I may as well chop out the area round the fuel filler flap and do that...then theres paint...I'd rather not
