Another Bloody Accident!!!!

What is wrong with people!!!!

On a dual carriageway, fast lane (right hand side) approaching an interchange to turn right when suddenly the guy in the left lane decides he wants to turn right aswell and pulls into my lane as im passing him and clips my car!!!!

Passenger side wing mirrors knackered with scuffs on the alloys. Several scratches to my passenger side from where he clip'ed me. Lucky its just minor cosmetic damage and no dents as i managed to swereve onto the grassed central reservation!

And guess what; he had the cheek to turn around and say its my fault because i was driving too fast and he didnt see me (must have been going at lightspeed then!!!!!).
Anyway, he decided to call the traffic fuzz who came and breathelised us both, came up zero and went on their way. What use they were i dont know.

A couple of witnesses that saw it also said it was my fault because i was driving too fast as i was approaching the interchange. One old F00ker said i should be banned and left his details with the 3rd party beacause "his wife is a magistrate" and will help get me banned! What a load of tosh. I did say to him if i was going that fast then why are there no skid marks on the road!

I did tell them ALL that regardless of my speed (which was around 55mph on a 70mph road) the 3rd party should have checked to see if there were any cars in the fast lane before he moved out. And he hit me, not the other way round!

Anyway, the 3rd party still think im at fault and think they are going to put in some nice whiplash claims.

DONT THESE FOOKERS KNOW THE RULES OF THE ROAD?????


My insurers already have taken the stance that the 3rd party are liable.

A like for like, or equivilant, courtesy car will be dropped off monday morning  :evil:

Jeezus christ, from what i've read it would seem they are at fault for pulling out. You get this a lot on the motorway too and you have to be f*ckin careful :angry:

TBH I think they were just victimising you for being young and driving a fast car - amazing how jealous some people can get.

Hope it gets sorted mate.

Most enthusiasts I know are the better/safer drivers on the road as they genuinely care for their cars. They dont want to see them damaged so take less risks around other vehicles (but enjoy them when alone on the road.... :evil:). I try to stay as far away from other cars as possible when motorwaying. I dont want stone chips on my bonnet or a damaged windscreen.

Even if you had "slammed on" you wouldn't leave any skid marks with ABS.

Make a note of what happened, by writing it down as soon as you can, it will help your insurance. take photos as well, even if its with your mobile phone in case anyone claims for existing damage.

The third party has already admitted "he didn't see you", make a note of it. As to the old FOOker, I bet he cant even see further than the end of his nose! Your insurance are used to spotting who's at fault, you'll be fine.

Before you know it you'll have your car back and it'll be polished up like new  :smug:

Its their fault. No doubt about it. As for proving your speed its simply your word against theirs. Its not like they have a calibrated tool to check your speed... and tbh how did they know how fast you were going when they didnt see you???

Ask them if they want to settle without going through insurance.. because they are definately at fault.

Some of these people are total idiots! 55 on a 70 is NOT too fast!!!! I'm coming across more and more people driving at around 40 on two-way-traffic A-roads where it can be tricky to overtake because they all bunch up together but the front car could be safely doing 60. In fact aren't you supposed to drive at the designated road speed? You should do just under 40 in a 40 etc etc. Join motorways at least at the same speed as the traffic?

End of the day, if you were in your lane and not exceeding the speed limit, I can't see him having a leg to stand on..

He and his witnesses can only guess at the speed. The old Fooker, one of his witnesses, came off the interchange and was on the opposite side of the dual c/way! Get on that one.
I've already notified the insurer because thats the way the 3rd party wanted to handle it because he thinks im at fault the crazy fool!

As far as im concerned its a clear cut case. I was in fast lane, he was in slow lane, he didnt look to see if any cars were in the fast lane and pulled out and hit me. Speed has nothing to do with it. Its all to do with basic observation (and using your mirrors)!

He cant get out of it. He didnt see me and moved over OR (if he goes home and thinks about it) he did see me and moved over. He hasnt got a leg to stand on. Either way hes at fault.


Robin you are right.
The Highways Agency wants all drivers to do atleast 67mph on all of its trunk road (Your probably wondering how i know that. Its because im a highways enginner and have worked on HA projects).

Anyway, im just relieved its just minor cosmetic damage because when he hit me i did think all of my passenger side would be dented to fook. Luckily its just a few scratches and scuffs on panels and alloys.

feel for you mate havin had the misfortune to have been whacked last week.
he hit you so pretty much end of imo.witnesses aren't worth jack these days,
I was witness to some tanked up crazy fool in an alegro on oth.er side of the road hitting a car coming out a junction, it ended up 50-50 decision at court????????????
