quick question on harnesses

hi just wondering if anybody knew if About harnesses and the MOT. I was told by someone that the car will fail an MOT because the rear harness was using the rear seat belt mounting point even through i am keeping the rear seat belts. In max power guide to modifying it says that keeping the rear seat belts and using the mounting point for harnesses is ok. Who is right?

I've no idea about what they check in the MOT but for kit cars in the SVA you have to have your harness mounts in certain locations - if you have them in the wrong place you can kill yourself!
