Thought I'd update for anybody who's interested. After several months and umpteen visits to the dealer(who has been brilliant,) I'm at a point where I'm about to reject the car.

So far its had a new mechatronic fiited the gearbox oil pump bearing replaced and then this week a new gearbox including new electronic dif and a new flywheel.

Unfortunately the noise is still there.

Has anyone else ever rejected a car and how did they get on? I've spoke to the dealer, vw uk and vw finance and they all seem to be in agreement that's I've given them enough chances to fix it but well see when it actually comes to the crunch.

You can’t reject a car that develops a fault 7 or 8 months into ownership. This is a warranty issue. They have to fix it or compensate you.
Sounds like they’re struggling to identify the problem, and perhaps they’ll make you a good offer for the car.

of course you can reject a car 7 to 8 months into ownership. The OP car hasn't just developed the fault it's been ongoing for months and the amount of parts that have been replaced will probably mean it's becoming uneconomical for VW to keep chucking money at it.

If they dug their heels in the onus would be on OP to prove the fault was present at purchase- and that would be very difficult
the amount of paperwork alone with what's been replaced should suffice  :grin:

So after what seems like an eternity I finally hot my car replaced. Not a straight swap but close. Basically they bought my car back and cleared the outstanding finance which was probably a little more than the car was worth. They then put me in a brand new 20 plate car with all the extras I had on mine plus all the end of line upgrades they've put on the latest car. They've discounted the car to the point I'm on the same monthly payment. The only cost to me was a small cost for the santiago wheels that I'd said I was happy to have if they couldn't get another with the brescia's.

All in all I'm very happy with vw and more importantly Haysledons of Barnsley they've been great from day one. It's been a long process but now I've a car that sounds so much better.

Fingers crossed this one will be fault free.

bit of a difference between warranty work and full car replacement though.

This seems all about the dealer taking back the car to sell to someone else that's unaware of the car's history.

VW being reluctant to do warranty work is a separate issue.

As UK law stands, dealerships do work for which they expect reimbursement for. If the dealership fails to get confirmation that the work will be paid for by VW UK, you ultimately have to negotiate with the supplying dealer - they sold you the car, it's up to them to fix at their own cost if VW won't reimburse.

That is the position I was in with the boot lid on my Polo. VW said they weren't paying for it and referred me back to the supplying dealership 200 miles away.

Sometimes it's worth the supplying dealership to be local, even if they can't quite match DTD prices. It's amazing how many VW issues the supplying dealership end up carrying the can for.

I think a lot of it boils down to the relationship between dealer and VW. I was told VW dug there feet in to start with but backed down after a few choice words from the sales manager.
Luckily they were my local dealer and although I didn't use DTD I did use carwow and when asking them about DTD they did say they dont really entertain them as the profit margin is so small it's not worth the hassle unless they're stuck with a car they cant get rid of that meets the spec.
