As far as I know, it doesn't use the parking brake. Its main mechanism is just backing off of the throttle. Acc does illuminate the brake lights though, you can spot other cars using cruise control on the motorway

The brake lights only illuminate when the brakes are applied, they do not light up when the car is using engine braking. You can see that at night as the brake lights reflect very well fro signs due to them being nice and bright.

Yes, I think that's what Fred was saying, too, but worth clarifying. Would be interested to check just what is happening, though, and which brakes are used. I don't think it's as simple as.

I've had the "brake or die" symbol ping up several times on my car and I'm so pi$$ed off with it. The car is going in for diagnostics next week. The system has triggered for no apparent reason several times and I believe there's a fault. I find it intrusive and a potential danger.

i had it apear once when turning right at about 20mph where a sleeping policeman was in the middle of the road with traffic lights. i thought mine just got a bit confused, the car was dirty at the time too. not happened since..

There is a sign for a garden centre near my brother's house that triggers the brake or die warning every time for me. Its just one of those things...
