I don't know if this helps at all, but I contacted my dealer when I wanted to cancel (was fed up of being messed around by VW, anyhow that's not for now). I was told that I would need to pay a £500 fee if I cancelled, the reason for this was because my order had already been accepted by the factory. I didn't cancel in the end, but my point is that the £500 fee thing coincides with what your dealer has told you. I didn't leave any deposit as it is a company lease.

Please read my post again. They have not supplied the car, they would not want to go to court and claim they have incurred costs.

Cars are cancelled all thetime and usually just get built anyway and sole to someone else. I have even cancelled after the car was built!

The dealer cannot keep your deposit.

I worked for a VW dealer in the sales dept and trust me, you can get your deposit back. they might make it difficult for you, because unless you pick your car up, all their work will become unpaid.  The one that loses the most is the salesman, because he has just lost a sale on the board.  The dealer can still sell the car but he will only benefit from that if he sells it again.

Simply approach the Brand Manager/Dealer Principal and explain your situation. He will not want to have a disgruntled customer and will simply tell the sales manager to refund you. (Trust me, this happens).


What I would say is don't lose sleep over this and if I were in your position I would spend more time securing my job than worrying about a car order.... ;-)

In general, and assuming the terms of the contract don't exclude it and the dealer has done nothing to breach the contract from their side, the dealer is legally entitled to retain the deposit but most don't as they understand circumstances change and want you to come back and buy a car at a later date.
