CCJ Enforcement
« on: 26 September 2012, 13:22 »
Has anyone used a private compant to enforce CCJ's?

I have someone that should be paying me some money but after smoking 40 cigs a day and drinking a bottle of vodka they dont seem to have any money left to be able to attend job interviews or afford a communication device.

A real nasty bit of work this one.... so need to know if anyone has used any 'private' collection companies. All within the boundaries of the law of course.

Have to asked the County Court for their certified Baliff's list?

From Direct Gov website for the rest of you if you'r interested in these things:

If the county court judgment isn’t paid

If you’re given a county court judgment and don’t pay, action could be taken against you.

The ‘creditor’ (the person who is owed the money) can ask the court to enforce the judgment. The creditor will usually have to pay a court fee.

The creditor can apply to the court to get the money using:

*   a warrant of execution (sending bailiffs to collect payment or goods for auction)

*   an attachment of earnings order (deductions from wages)

*   a third party debt order (usually used to freeze money in bank or building society accounts)

*   a charging order (a charge on land or property owned by a debtor)

Warrants of execution can be issued using the Money Claim Online website, the County Court Money Claims Centre or the local county court.

Thanks!

Spoken to a local debt collection firm and although they charge a fee (12%) whilst also more than council for their collections, she assures me they are more thorough in their visits.

This is due to them being paid very little if they dont get anything. Just not sure I want them to make monthly arrangements on my behalf if she cant pay  :undecided:  Not to mention the fact they hold all the money she pays until its a lumo sum. If you want it any sooner there is a £15 charge for each draw down.

They absolutely did. They recovered a £44k debt for me in 2009, at a fee of only 10%. Absolutely brilliant company. Especially as during the period of recovery, the new year had elapsed, so the bad debt was written off. The chairman lost out on £27k net profit, but we started in January with £39.6k GP, before a sale was even made!

Going illegally, will surely loose you money if the other persons clever enough. Only magistrates use private bailiffs, in a civil money claim only court bailiffs/sheriffs can reclaim... But they are useless so id look into another method to enforce the warrant rather than court bailiffs.

Have you ever heard of kings ransom?

They're totally legit, just very clued up and not afraid to use solicitation from the onset. Usually enough to scare any potential aged debtors.
