accident advice

need some advice from someone in the know, hoping someone on here knows if i can do anything

this was an accident at work, im a bus driver, about 2 month ago a pedestrian walked in front of my bus, was a bad one but thankfully not fatal, full investigation by work and police and i was found 100% not at fault.

but now my questons, i have been on sick for 5 weeks with bad back cos of it, no head rest on seat so my back took the hit. but now work have said its an accident but they werent at fault so there not paying me all my wages, spoke to union and they basically said the same as management.

i still see it as an accident at work and surely i should be full pay, but would i have any joy with ringing a solicitor? in the back of my mind i know the only way theyll do it is by taking the pedestrian to court, but he looked like a foreign student and i could bet that even if i won in court he would just leave the country.

anyone got any advice?

What does your contract say about sick pay? If you're on sick leave, the min should be statutory sick pay which may be less than your weekly income.

Get your contract and speak to citizens advice bureau, ACAS and look at the direct.gov.uk website.

contract is for 70% pay, ive been on ssp but didnt notice cos my money just stays in bank for bills. luckily i had extra to cover. union said contract is worded so i get sick pay if company is at fault or an insured 3rd party

i rang cab and they said i can go through uninsured driver policy, then i reminded him it was a pedestrian and he said i can sue him but will incur court costs and not guarantee any return.
