Does not matter.....if it's privately owned then write back to them offering to pay the extra £1. Then if they do take you to court the offer will look good in your defence. I had one some time back and did this and heard nothing back apart from the company trying to bully me into paying up. Just ignore it and they will give up after a few letters.

Should i bother if their wasnt any machines about to pay, My friend just told me theirs one on the bottom floor. Buts theirs 3 exits to the building, two go out onto the street and one (the lift) go down to the shop. And i dont use the lift i just go out onto the street...

You don't have to offer but if it went to court then they would look upon your offer in a good light and probably throw it out as a received offer. If you make an offer the company trying to fine you will also get the message that you are not a mug and know your rights. They send these "fines" out in the hope that people just pay and I know a couple that have just paid up.

I wouldn't even appeal if it's not council owned. Ignore it, they can't get your details.

They have my car details and my address...

How they get it?

Don't respond any. Never confirm they have your details.

My experience with the private parking firms (my post form the AlanD thread)

Quote
I have one from last year for parking in a KFC car park for 10 mins (not exaggerating the times are on the ticket) they wanted £75 within 2 weeks or it would go to £150.

I ignored the second letter requesting £150 and then received a third letter saying if I don't pay they will hand over to bailiffs and 'could' receive an even larger fine.

A lett from 'Newlyn' bailiffs came through (which i later found out is owned, or part of the company that sent the original ticket) and they wanted £238.

I rang them up and asked about how I appeal and they said they would put it on hold for 300 days. This period expired sometime in august and I received a reminder that I owe them £238 and that if I didn't pay they said they 'may' register with the court which 'could' result it a larger fine.

Before they can even send the bailiffs out they need to get the case approved/accepted or whatever by the courts AFTER registering it. Even then I think they have to have a valid case to be able to register it (mighty elvi could confirm this).

So I ignored that letter because they were clearly trying to use a bunch of scare tactics. I was prepared to go to court.

They then sent out a big scary FINAL WARNING letter OOOOOO scary. Saying that if I did not pay up i could face further costs and legal action bla bla bla.

I have ignored that and I haven't heard anything for about 2 months. Ignore them unless its a council ticket. If you do want to contact them don't make any claims (i.e something you might have seen on a sign) without real evidence, don't be rude, threatening or sarcastic and only contact them if they contact you first.

Remember, its just a scam and an utter load of bullsh!t.

Also ask them to prove it was you.

Just ignore it.

Ant, private companies can get your details from the DVLA, they will sell them!

I was told they can't, as anyone could then pay for your details. But all the same, if they do, don't respond and confirm your details are correct.

Unfortunately they can and they do but they can't be bought by anyone !

I had something similar... I phoned the company up and told them I found a ticket on my passenger seat in the morning. However I had not been driving the car the night before.

She told me I had to pay the fine as it was on my car. I argued that it wasnt issued to me and a group of friends had borrowed the car.

I was told I would have disclose who was driving.. when I asked he under which law that was, she didnt have an answer. I swiftly told her to stop sucking balls.

Never heard anything since
