eBay Tailgate Problems......

I bought a tailgate off eBay from Strictly Dubs.  It has turned up damaged and I have been quoted £80-120 to fix it.  It cost me £45 with SDubs taking a further £25 for postage.

Anyway, SD are refusing to refund me a penny.  They have said that they have to file a claim with the courier and then after 30 days I MIGHT get £45 back after the courier has compensated them, not the £70 I have paid.

I thought as an eBay seller they had a responsibility to deal with this, not say the couriers have to do it and after a month I might get back less than I paid.

What do you guys think I should do?  Im thinking of opening an eBay case and instead of returning the tailgate get a partial refund that is better than £45.

The responsibilty lies with the courier.
Providing the seller packaged and protected the tailgate properly.

Ultimately yeah, but as a seller shouldnt Strictly Dubs refund my money then keep the compensation in 30 days?

eBay is all about customer satisfation and feedback.  As a vendor on there I would have thought that they should look after their customers or they are going to have lots of negative feedback.

I have no idea what eBay would do if I opened a case, all I know is that I bought it and paid as I should and received somthing thats not as described.

If strictly dubs value their customers and reputation they should at least try to help you sort this out, ebay couldn't give a toss about customer satisfaction and the dispute resolution can take a long time.
I work for a palletised distribution company and i see damage like this now and again but the courier should be insured for the value of the item.

My missus signed for it!!!!

I dont mind the fact that its damaged, these things happen.

The thing that gets me is that they want me to wait 30 days for the Courier to pay Strictly Dubs before Strictly Dubs refund me.  Thats not good customer service to me, I did everything that was required for my side of the contract of sale.

Im pretty flexible as in refund, I just think that £45 is taking the pi$$ when I paid £70 lol.

Everything takes 30 days on ebay, its a ballache but its the way they work.

The courier won't pay out a penny if it has been signed for, as I've found out in the past.

unfortunatly you need to send this back to stricty dubs, as unfit for purpose. As the seller and as a business it is downto them to ensure you recieve the goods as described. However they need the item back and need to prove they have recieved it. I speak from experience having run Not Escorts on ebay for a good few years. Postage cost will be refunded with an ebay dispute. I would also email them with a strong yet polite letter stating as good not desribed it is a breach of the sale of goods act and you have a contract with the seller not there courier and as the item is of unsatasfactory quality you are entitled to a full refund of all your costs. If not you will look to take the matter furth with trading standards, small claims court etc. I would imagine they will refund instantly to avoid the hassle we always did when couriers damaged panels which is why we stopped sending them via courier pallet etc it was collection only saved so much hassle. with no exception and never dealt with buyers own couriers either. Do a paypal claim and they will have the full funds put on hold till the matter is resolved but bottom line you must send it back
