Your in a bit of a sticky situation to be honest mate

When you use driving over cars through your own insurance your covered TP only, so unless you can get the third party to accept FULL liability you will not be able to get the vehicle repaired through your own insurance..even if it goes as 50/50 you still won't be covered.

What county did it happen in mate?  The Police will be investigating it, get in touch with the Officer investigating and see what his findings are.  From there put the insurance company in touch with the Officer and get the witnesses to give accounts.

Give you a bit more to stand on.  Did the other driver admit fault at the side of the road?

Hmmmm, did you tell that to the Police and the insurance.  Get the Police to contempt note him.  If they can get him to admit fault then that could be useful...
