67 in 40 Zone Lazer Gun!!

I stopped back in Feb 20th 09 from some copper who was hiding behind a barria on the A3 underpass ( he was not visable) and no way could he been seen. There was a car 20 meters in front me also a car at my side. So why did he pick out my gleaming Edition30 said I was doing 67 in a 40 zone??? He offered me 3 points 60 quid fine, but I told him I did'nt trust the gun he was useing and I needed to see the calabration cert. By this time he was getting very angry & shirty with me. Can you tell me why I have not heard anything since this event from the cops? Thanks Steve30

PS he did say he would take to court? But not heard thing since? :laugh:

You probably haven't heard anything as the unit that processes the paperwork is very slow at doing so - as they have lots of other stuff to deal with and they have up to 6 months to summons .... An officer would not show you the calibration certificate as they don't carry them with them for the unit.  The individual Laser normally has a sticker on it put on at the same time calibration is checked.  I show people that if they ask. 

The beam from a Laser - which was probably a Pro Laser 3 .... if you were stopped after Tibbetts underpass in Wandsworth - is very narrow and the device is not regarded as even potentially inaccurate like, say, the LTi 20/20.  The officer has to carry out 2 checks when he takes the Laser out and then when he gets back.  That is in addition to checking the calibration is in date.  They record these checks in a pocket book.  If you feel you weren't doing 67 then plead not guilty if and when you get summonsed.

It is always possible the officer found something wrong with the device when they returned to their base and accordingly voided anything they had written.  As you weren't issued a ticket they don't have to cancel it .... when reported for speed you are reported 'for the question to be considered of prosecuting you for' .... so if anything turns out to be wrong then it simply doesn't go ahead.

Was the officer on the bridge over the underpass - in which case he would have been visible .... or was he by the armco at the end of the sliproad ?  or indeed somewhere else ?

The officer's car was on a slip road , no way you see could the officer , he was on the other side of tippits underpass hanging off the barria (but denfinlty not visable) I belive I was doing 45-50 in 40 zone no way 67!! It was also in the rush hour at 17:15pm on Friday night bloody busy at that time on the A3. My question is what about the car 20 meters in front me? Why was this person not stopped ?  :angry: If I go to court, Can I challenge it? Whats the best way to go about it?  :huh: Thanks guys for your support Steve30 :smiley:

Overturn Your UK Speeding Fine

However, there are opportunities to challenge your speeding ticket or overturn the speeding fine. Here are some of the key grounds for challenging a speed ticket:

    * Make sure that all the details on the speeding ticket are correct.
    * If you get a notification of intended prosecution, make sure it has been sent to you within the 14 day time limit (plus a day or so allowed for post to get to you)
    * Make sure that the vehicle details and date, time and location of the alleged speeding offence are correct. However a minor typograhical error will not help you.
    * If it was a speed camera ticket, go back to the place where it happened. Are the speed limit signs correct and legal eg they must be on both sides of the road, are they obscured by trees etc. Take (non-digital) photos if necessary.
    * If you are sure that you were not speeding you can ask for copies of the photographs and other evidence
    * You were not the driver

If you are the owner of the vehicle and get the NIP but think that you were not the driver at the time of the alleged speeding offence, it is your responsibility to make every effort to find out who the driver was and fill in their details on the NIP. If you make every effort but still cannot find out who the driver was, you MAY have a satisfactory defence, but the case will almost certainly go to court. It may be that the speed camera photos will show who the driver was - GATSO photos from the rear are usually inconclusive, but Truveloe photos from the front may be clearer. Failure to supply details of the driver is subject to a 6 point penalty.

If you are alleged to be speeding but not excessively you will be offered a fixed penalty notice which will have a speeding penalty of £60 fine and 3 pointson your licence. If you want to contest the speeding penalty you will have to go to court. For alleged offences involving faster speeds you will receive a court summons anyway. If you know you are guilty, you can attend in person and plead mitigation - previous good record, it was a momentary abberation, it will affect your family/ job etc. This may well result in a lower penalty.

If you are going to contest the case: keep all relevant paperwork, get advice before completing the NIP, don't lie! - it's perjury. You may want to challenge the speeding ticket yourself or get legal representation from a lawyer who specialises in motoring offences.

 :huh: Thanks very much for your input guy's its much appicated. But it still leaves me feeling unsure what to do????

I wish i took the 3 points when it was offerd + 60 quid fine? There is no going back it now, so I shall fight it through the courts. I was working at the time in the area. I have a clean licence for 19yrs now. Just didn't need it .  :sad:

I don't know what the procedure is  but don't they have to send you something in the post so that you take your counterpart down to the local police station so that they can add the points? If you don't hear from the in 14 days doesn't that mean that you're in the clear?

Like I said, I've never been in the situation but that's the general feeling I get from mates that have been.

No , the officer said it could take upto 6 months before I hear anything? I do think the Gun he was useing was wrong (lazer) Ok I was doing about 45 MPH but defintly not 67? There was a red passat 20 meter's in front , also a car at my side and loads of traffic around at the time. My question is, has he got the right car??? Was it my car going at this speed. Who are they going to belive me, or the man in blue or the GUN ???? Your thoughts on this are very much appricated Steve30  :huh:
