« on: 09 May 2009, 20:50 »
Argh ! the guy i bouhgt my mk2 8v off has decided to register it as scrap !. . . . it was still under his name as he hadnt found the reg certificate and then got a call from him telling me that its scrap. so i asked why he did it and he said ' i want it back to scrap. . .  ive read about the new scheme and i fancy a new fiesta' ( hes owened the car for 2 years ) WHAT A TO55ER ! is there anything i can do to declare it back on the road ?? someone told me that untill the car is actually 'crushed' or destroyed then the DVLA cant declare it as scrap. . .  any hellp would be appreciated =]

Not 100% sure on this but I think he has a right to the car as it is in his name.

Yup, he has the right to it. There's part of the V5 registration document (V5C?) that you're supposed to take which proves you own it, while the rest of it gets sent off to DVLA, car gets re-registered in your name, and new V5 makes it's way to you. That's why you don't hand money over unless there is a V5...that, or it could be stolen, and again, you've got no proof of ownership

Do you have any kind of receipt from him, or a copy of yours that he signed?

unless you have the green bit of the v5 your pretty much stumped mate

however - he cant scrap it - that is all done once the dealer has verified the deal.

unfortunately a lot of cars will be going this way i think

Being sneeky back at his sneekyness,

Download the form from the DVLA website stating you have lost the doc, and you are applying for a duplicate document. You can state you are the new owner and if needed, send them a photo copy of the half of the doc you have.

Probably cost you £19, but get it done sharpish. Maybe you can take this into your local tax office to get the registration in your name, not sure.

Thats guy sounds like a loser matey, but its happening alot, so act quickly.
