Whose fault and how much?

Hello.

A friend's g/f reversed into a GTI MK3 driver's door (while it was open) and has taken the door out of line. She was going into her allocated parking space and he was parked in the access tunnel. He reversed back (on the phone too) and with his door open so she could get past, she then drove into her space and needed to readjust it so when he went his sister could park in the space. Unbeknown to her, his door was still open and she reversed into it, not at speed but enough to take the door out of line. Who was to blaim in your opinion guys?

Also how much do you think it would cost to realign the door? They coudn't shut it post prang but they were able too so it can't be that bad.

They'd want to bypass the insurance so it would be done for cash.

The moving vehicle was at fault. You are deemed to be in control at all times and able to negotiate all obstacles.

To be honest i think the insurance would just say nock for nock, There for no-one was to blame. As it wasnt on a public highway as well it could be affected.

The law states that its your fault if you hit a stationary object. However insurance companies will often just wipe there hands iof this sort of complicated situation and say nock for nock.

It shouldnt be too much, Just needs bending back into place and adjusting. I think it would be better off in the end if she just pays the small fee for it just to avoid any cosly arguments, After all its just money ;)

If its not too bad (would have to see it) use a trolley jack and a block of wood and line it up that way. Thats what we do anyway. ;)

Re. the last posting, matey wasn't able to shut the door at first but now can so it can't be that bad. Maybe the jack and a bit of wood would do the trick.

The person doing the reversing was deffo at fault.
