Wheel clamping on private land illegal from Today:

Pasty tax comes into force today.

Does this mean I'll have to start paying fines for private parking tickets?
-
Yep and the old " just don't pay " brigade will be fcuked as they will just send the fine direct to the registered keeper

True, but it's still a civil matter (breach of contract) as before, and they will still have to take you to court (as before) to get their monies.
Paying a token amount or telling them to "see you in court" still applies.

The problem is they will just instruct a debt recovery firm to Chase you down and if you don't pay you will prob get issued with a CCJ! Then your credit rating is fcucked!
I wonder if the fines will have to be capped if you get a ticket?

fines are still uncapped (£150 at my local supermarket now!!)... and why would you get a CCJ as that would mean them having an expensive day in court where they would most likely loose (especially if you offered them the lost revenue! of let's say £1!)

I've never understood the concept of clamping. If they don't want you to park there, then by clamping you, they're forcing you to continue to park there - defeats their argument.

yes but it also relieves you of £150 to find out what its like to park there... which makes it viable to park on someone elses land.

Yes, but, if you must not park there, they've forced you into continuing to park there.

ok need to ask this, i work for british gas and alot of estates we have to go on are private/aka council and they have clamping, so am i right in thinking that they can no longer clamp me for doing work on their tenants property?
could someone post a link to the legislation?
-
No..this is in relation to the owners of private land and clamping. If it's the pubic highway/council owned or controlled land, the the law is as it was. They can clamp/fine you.
If you overstayed / violated parking restrictions on a private estate, then they can no longer clamp you, Now only peruse you (as the owner of the vehicle) through the courts, to get a civil remedy for breach of contract. If you fail to pay - if they win of course in court - then they can get the bailiffs on to you as you now have a CCJ against you.
However, if it's your local pikey estate under council control, then they can still clamp you if you violate parking restrictions or fail to put enough coin in the meter.
Have a read of the BBC link in the first post.
