Title: 'Notice of Intended Prosecution' ??? Any thoughts???
Post by: laitymk3 on 14 June 2012, 08:35
Ok so it’s just a bit of chat/query I have really. A couple of Sundays ago I was travelling home on the A1 with a speed limit of 70mph and got flashed by a forward facing speed camera. I was clocked doing 82mph and received a ‘Notice of intended prosecution’ am I right in thinking this will be three points and a £60 quid fine?

Also has anyone had any experience with speaking to the police about any of this? A bloke at my work said write a letter to go with it explaining that I have a clean licenses and that I am sorry for my mistake blah blah blah…. It won’t happen again. If I a honest I do not see this working but wanted to know if anyone had done anything similar?

Just one more thing…… anyone that is thinking of replying with ‘ you were speeding you deserve it’  please don’t bother, I do not drive like a lunatic , and anyone that says they have no exceeded the speed limit YOU ARE LYING.
Thanks

Yeah, your more than likely looking at 3 points and a fine.

Take them up the arse and enjoy the insurance hike!

But like you said, we all do it, just watch out for those jeffin cameras!

Cheers for that lol

not think there is a chance i can go on one of the dikie seminars as its a first offence?

Yea i saw the camera at the last minute and decided against slamming my brakes on, due to it being wet.

Dual carriage way or actual motoway?
first offence, same as RJ 3 points comming your way!

Dual Carriage.

When can you opt for a seminar then?

They can only offer it, but with such a small speed over limit it will be fixed penalty if you were doing 90 different matter!
keep any letters short and sweet if you have a valid reason why you were doing those speeds (usually emotional one)
then state it what ever happens you will get points though, usually the fine is based upon income so if you have no money then state that.

I thought the seminars were more expensive i.e. £100 but relieved the fine and points?

might state I am skint and have no money and a young child.... ha play that card or I might go for the I had a lorry right up my chuff and had to speed up to get a safe distance as I felt under pressure from the large vehicle behind me.

i really dont think any of this will help but got to be worth a shot.

I REALLY wouldn't bother with BS letters to them.  You don't want to risk saying the wrong thing and escalating anything, do you now?

You'll get offered the course once you've fessed up to the offence.

No nonsense response Diamond Hell, thanks. Do you know any more about the courses do they relieve the points + fine or not?

TBF I've done a letter for someone else DH and they got let off it was a short sweet letter stating they were in the wrong, but with mitigating circumstances!

you are correct,

you dont drive like  a lunatic to speed.

but you did speed

so a punishment is due.

TBF I have just filled in the back of the notice and shoved it in an envelope. Like you and I have both said I was speeding which is a fine. I just got unlucky and will make sure I do not get caught again, and obviously never brake the speed limits again (which should be 80mph anyways) but that’s a different argument.

My boss was clocked doing 56 in a 40 zone. Was a single carriage way 60 mph road (he was in a truck)

As its his first offence he has been offered the seminar and i think it was about £60. If he does that (which he is) then he doesn't get any points for the offence!

No nonsense response Diamond Hell, thanks. Do you know any more about the courses do they relieve the points + fine or not?

If you get offered the course you won't get any points and you won't need to declare it to your insurers (last time I checked).  You are eligible for a course if you haven't been caught for anything in the last two years and have no points.

The course costs are a bit more than the fixed penalty fine, but you need to weigh up the surrounding effects/costs/risks etc - it's a complete no-brainer - you do the course, even if it costs you nearly the cost of the course to get to the bloody thing.

TBF I've done a letter for someone else DH and they got let off it was a short sweet letter stating they were in the wrong, but with mitigating circumstances!

They'd want to be some pretty solid mitigating circumstances!  What were they and how long ago was this?

I don't think there could be a lot of mitigating circumstances on the A1.

Wife bad luck she drove when there was a motor bike event in west country so I just wrote saying they were on her case doing 100plus and to check the camera for how many motorbikes it caught within the hour of her getting snapped.
The judge was alright got turned to an SP30 so all good!
As for the speeds she got caught at  :lipsrsealed: TBF her old man was in bad shape and she was driving way too fast to get down there, but its a 5 hour trip one way for her?
All I can say it should have been a ban  :lipsrsealed:

Unlucky

I thought I got caught by the front facing camera on the way home from Norfampton recently, it's been a butt clenching two weeks but nothing now after 2 and half weeks   I did brake when I saw the camera and have taken it easy since, it's shat me up and made me think twice about speeding.

Don't they revoke the points when they see you have a diesel and they realise it was impossible to be doing the speed they clocked you at?

It varies so much on whether they offer the course or not. But I wouldn't use lorry excuse, I was in court where a guy on a motorbike was caught speeding, by a policeman with the laser gun. The bloke was sticking to the limits but went 6mph to get round a lorry due to spray, photo showed it was wet road and raining, with the lorries spray. The magestrates wouldnt have any of it as he still broke the law even though he appealed against the decision. All in all it cost him many times more than it would of been to take the points and fine.

I'm shocked how I've still got a license tbh, I've had the local sergeant take my keys off me for my car on a speeding occasion. Yet I've still got a clean license.

What is wrong with these people!? A very illegitimate and fair reason to go 6mph over the speed limit. A clear common sense malfunction with the courts there, feel sorry for that guy.

Bromley Mags this was at, I felt sorry for the bloke tbh, for something so stupid with more than adequate proof, the way the magistrates saw it was he broke the law either way even if it was for the safety of his well being, yet they give other people a slap on the wrist for serious crimes. But then the magistrates aren't the sharpest tools in the book, nor is any of the judiciary  :lipsrsealed:

I got let off from doing 60 in a 40, it involved me sitting down in the police car and being shown a load gruesome pictures and vids from local accidents.
Was a let off but it did slow me down more than i expected

Bromley Mags

Yeah, I know the one . . . . .

The lad before me in court got away with a petty punishment for his crime but thats another story in itself. The jist I got from my short time in there was that if you work, earn money and pay tax then you'll get bent over.

something ive been told is that if you think youve been cought, get a mate or someone whos insured to drive down that road in your car...

then if you get a letter through ask for the picture.. if its blury enough to not be able to make out which one of youse it is take it to court say that you arent sure which one it is as you both drove down that road in your car not long after each other but as its your car you will take points... its a worse offence to take points for someone else than it is to speed therefore noone gets points as they cant prove who it was.

or if you arent botherd about lying in court then dont get someone to drive your car and just get them to say they did.

how true this is i dont know but i remember talking to someone who said that theyve been cought speeding and used it and got away with it... not really much help to your question but hey ho.

They probably saw it as why didn't he slow down a little to let the lorry get some distance between them then stay at the same pace as the lorry way back so he didn't get a face full of spray... :undecided:

Its the way I would look at it even though I am majorly against the current speed limits and enforcement techniques (far too low and far too greedy) as if you cant see for spray when behind the lorry, you cant see whats coming!

a) Goes both ways, but lets say the lorry was doing 45 in a 50 zone with two lanes, rather than stay back you could accelerate and go round him, in doing so you hit 56mph with the intent to then drop to 50.

Or

b) Do you fall back to 40 and only regain back to 45mph matching the lorries speed in front with now some distance between you?

I know I'd do "A", have done so on many roads, its a big national sign on a country road and there's some tw@t doing 50 opposed to the 60, for me to get round, doing 60 would be dangerous as most country roads don't have much straightness, so I'd hit 70, get past and drop to 60mph... But thats my view

I've done the speed awareness course- it lasted about 4 hours. Basically you meet a bunch of other speeders and tell each other what speed you were doing and why. Watch some videos highlighting the dangers of speeding in urban areas, and also some reaction time activities. There's a good video involving basketball which I won't spoil for you if you haven't seen it before.

Quite interesting really, and although I still find myself speeding on motorway/national roads from time to time, in the 20/30/40 zones I make a conscious effort to keep to them as this is where speeding does the most damage if you hit someone.
