Candidate 2's previous employer is a friend of a friend of the golfing partner of the potential employer. It came up during a BBQ at a mutual friends Nephews Christening.


Very unlikely also very unprofessional, plus depends on the size companies you work for, size of the place you live & if you even work in the same town you live.

I certainly wouldn't dismiss a candidate form a job because of some chinese whispers of a tribunal in fact if he had been well within his rights & had be dismissed unfairly i would understand completely.

The laws of employment are there for a reason & should be adhered to i know working for a very big company we have to do everything by the book.

Companies that dont follow employment laws deserve to be dealt with IMO

What im saying is....... He could be making things more difficult for himself then they need to be?

And if you're insinuating i dont follow employment law and need to be 'Dealt' with .....

Wasnt saying it was for him...... but he could be a fool if takes advice from a load of people on the internet, some of which work for Big corporate companies. And people in business will know, that it can be very different at an SME compared to Corporate, where lawsuits, tribunals and such are everyday business.

I know loads of other SME owners, and we all talk. Corporate...its departments, not people, you deal with mainly

I wasn't actually insinuating anything but if your company didn't follow employment laws then yes they should be dealt with.

We don't live in the dark ages anymore employee's have rights & companies need to treat people correctly. My point was if someone can be sacked for making an honest mistake then a lot of people would be out of a job a lot of time.

Obviously a different ball game if some is constantly making mistakes but even then maybe rather than just blaming them you have to look at your training programme before you kick them out the door.

There are process's that have to be followed if a company doesn't follow them then they pretty much deserve what comes to them.

Just to add to this discussion. An employer will probably be asked in a reference 'would you re-employ this candidate?', the ex employer can say 'no', and not give a reason. Perfectly legal.

Why is this illegal? you don't have to hire someone first, you can request references first.
