Mk7. 5 gearbox

I have a 2019 mk7. 5 Golf GTI performance with 13k miles . There's been a oil leak from the gearbox area since I got the car in April.
I got it from a main dealer with 7k miles FSH. The service at 3k was clean the service at 6k advised of oil leak. Its been back to main dealer 3 times now replacing oil seals on transfer box twice and still leaking oil. 4 time the gearbox has been removed to find that a dowel from the flywheel has come out and possibly damage the bell housing thus needing a new gearbox. Main dealer now says the gearbox may have been removed before and if it needs a new gearbox then this would not be covered under warranty. Any advice and help would be much appreciated.

My advice is not to get involved in any discussion about what the warranty does or does not cover.

The warranty is irrelevant.

They sold you the car with an existing problem- which they appear to acknowledge.

Either they fix the problem properly , or you should return the car to them and get your money back.

It is still under 3 year warranty and probably had a two year vw warranty when bought as a part of the sale so must have met vw warranty criteria to extend it. The leak was acknowledged at the 7k service so as Yusee said known fault at sale so up to the dealer to sort.
Mk6 GTI Carbon Grey, 2010 Bluetooth and voice fitted, a few VCDS mods still a comfortable family car. Red Scirocco 2011 twin charger stage 1 - enjoyable drive now gone.  White 2016 Polo GTI (roller skate on steroids) replaced with an Indium Grey 2019 7.5 GTI PP.
