mot infomation needed

I had my partners car mot'd the other day and it passed with no advisors,she drove the car home all of 2 miles.
I reversed the car on the drive that night and the exhaust was blowing but wasnt when i pulled it off in the morning before the mot,anyway ive just jacked the car up to find a big split almost all the way around the front section of the pipe and a hanger snapped at the rear.
Im wanting to know if this is a fail as i assume it is? the garage now says it was already like it and is not a fail but a previous car i had failed on the same thing.Before i take it further im wanting to know what is true ?? is it a fail,is it an advisory??

it should have failed as 9/10 they wont emissions test a blowing exhaust to be honest its possible that if its a very slight crack and not major it could have passed but i would replace the exhaust anyway and have you got any proof that it wasnt blowing because if you try taking down the VOSA route you will need to prove stuff like that

It would definately have failed on the snapped hanger.

I obviously cant prove it was cracked before i took it and i cant see how i could prove that,the mot tester said he did notice it but it wasnt a fail or an advisor which i dont believe.I got under the car this morning to find the exhaust spewing every time i rev it.I then saw the broken hanger.
One of my best pals works at vosa so i will be taking it further,i think to be honest there just fobbing my girlfriend off because shes female and due to my very short fuse but excellent negotiation skills she wont even tell me witch garage it is yet.

cracked exhaust is not a fail neither is broken hanger as long as exhaust is still supported and it passes emissions. the rule/ standards for exhaust condition and security changed in january.  to be honest as an mot tester my self you should have gotten and advisory for it but there is no rule that says you have to so depends on tester. either way i would not get vosa involved as it will be a load of hassel you dont need Ie vehicle needs to be parked up till they retest it at your expence. they do a full test not just what you complain about and they miss nothing pass or fail. vosa will not tell you if it was like it bofore test so you have nothing to gain. i would try to keep cool and discuss problem with garage realistically they have not cracked your exhaut or broken your hanger but they might help you out

I would have failed it any thing that supports exh I fail, for blowing depends how loud and May fail when do emission. But ome people sdo pass and some fail depends how strict they are.

lets put it this way,the exhaust is split 3/4 of the way round and hanging down nearly 4 inch from where it should be,the car has been driven 2 miles back home and sounds like a tractor now,if i get no joy in the morning the vosa office is 2 streets away and they can keep it,who cares what they test?? At the end of the day my kids are in the car and the fumes are overpowering me on the drive,i would rather buy her a banger for a few days than risk carbon monoxide poisoning my family  :angry:
