Title: Insurance please help
Post by: chrisford_vw on 14 December 2008, 01:05
Hi I got stopped in my golf for no insurance, I am/thought I was insured with Lloyds TSB, I thought that the no insurance was due to me not sending my direct debit details back (because of a letter sent earlier)(stupid I know). This resulting in my car getting towed.

I rang TSB and they said that they had not had proof of my no claims bonus so they insured it as a temp car for 1 week and i was still insured on my previous car.

When I originally phoned up to add my car they said that about the temp but as soon as I sent in my NCB they would insure my new car automatically. I sold my old car and the new owner got insured on it so 2 policies on one car (is that legal?). I also asked them to listen to the recording of the phone converation.

I got re insured on my golf and the insurance said I could go and get my car, I then went to the police station to give forms in so I could get car back. i was told it was law that they needed a policy document as the only way to release my car (so the insurance advised me wrong). This resulted in a £140 charge to get my car back.

I rang TSB to get my document sent out and they said it would be here the next day (it wasnt) so I rang back up they said that there was no record of me requesting the document, and that they would send it out again. I also asked them to listen to the conv about this.

The next day I got the letter courriered I to the house and again recived one the next day (one of which had never been recorded by the TSB?). Even better they had diffrent insurance times on one at 12.01am and one at 1.34pm on the same day.

They were still taking the money out of my bank and still are without the direct debit insruction despite the earlier letter saying that they would cancel the policy.

They have my mob number to phone me and did not throughout whats happened and not even to tell me the results of the tapes. I have a court date for the 2nd Jan and am looking at 6 points £200+ fine and court costs. What should I do - Please help

Cheers Chris

cant really cvomplain if you wernt insured, you had no documents and they had no proof on no claism what you expect, and course you need the policy documents to prove you are insured on it, not going to let you have it back uninsured (or without proof) when theyve just taken the vehicle for that reason

When i first got my golf (may) and they put it on temp, I sent my NCB proof before the temp ran out as the operator on the phone said to me that she would put it on as a permanent when they recieved them , they recived them but they still did not sort out the golf (Knowing that it was my only car).

I was pulled in September and I thought that me not having the docs was due to it getting lost in the post (know I should have phoned but only have a mob and it costs a fortune from the phonebox too 0845 number and you are on hold for upto 35 mins).

The operator when I got the Golf insured 2nd time (properly) said that I would be able to get the police to phone them to confirm insurance.

All I would have asked for was a courtasy call or letter about the no claims whithin a short period of me taking out the insurance  or for them to tell me when I phoned to change my adress (april). They can change adress without ncb proof but not car?????. And also a letter or call saying that they had recieved my proof and that they were not updating my car from temp to perm.

Its not the police I am upset with cracking job (exept may - september and long journeys to wales and sunderland past cop cars and they didnt spot this) they even give me a lift home and were telling me tales of police chases at 160mph up M6 after an evo. Its the insurance they claim no liability after saying that they would sort my insurance out an didnt and said that they would check the tapes to confirm this and have never got back to me.

TSB + Bad customer service and one hand that does not know what the other is doing.

You are at fault really mate because its down to you to ensure you was insured even though the insurance company proberly fcuked you about etc its won to you to proof that you was insured etc. Thats why its always worth keeping notes of times you sent paperwork etc and always check that they have received it.

Insurance Docs are very Important. . . you thinking they had just been lost in the post is your fault really mate. i would of gave them the very max a week to arrive then a phone call!! i know you said it cost you a bit ringing from a mobile but a hell of a lot less than what you be paying to sort things out now.

You can't really blame the insurer as they did also tell you about it being a temp car for a week. . i'm afraid its upto you to keep a track of things and make sure everythings in order. . insurance companys will just sit back and take your money.

One thing's for certain - no insurer will backdate a certificate or cover note as it is against the law. Therefore as you had not sorted your insurance correctly (all the issues with temp insurance), it will have come up on the MID (Motor Insurance Database) as an uninsured vehicle which is probably why you were pulled over. Takes a few days to go through the system so provided your insurance company had received instructions from you to hold cover, you would be insured - this is why the police issue 7 day wonders in case the insurer has not got a certificate out to you in time. However in your case it looks like there has been a breakdown in communication and unless you can get specific recordings of the call you made to hold cover, I'd say the court will issue the points & fine.
