Title: pot hole!

Just got a letter from council ( insurance department) saying they are not liable for the damage to my car after hitting a pothole in december, split tyre ect, they say that the area was inspected on the 8.12.06 ! and was within the 12 month period, i.e in another 5 days they would have been negligent  :angry:, I have asked to see the report that they did between my accident late monday afternoon 3rd and friday 7th!.

They say as some people said before, unless anyone else has reported it i have no chance ect

Do I just accept this crap, what else to do?

If they say it was inspected on the 8.12.06 and they can back that up, there's nothing you can do.

if it was inspected and report said it needed fixing then it needs to be fixed. so yes.
i had the same sorta issue with a drain protruding from the cub while they were doing road works.. i hit my rim, they said not their problem several times, we didnt take it, they then told us it was the contractors and not their fault. after getting legal advice (free with house insuraance) they said they were the employers to its up 2 them,

But what's the price put on the sheer amount of time arguing with a bunch of idiots?  You could waste so much of your time over the cost of the tyre...

is true. but i wasnt paying £60 odd to fix my rim, so worth it for me
