Need some advice guys and girls!
So my ex owes me £500, has done for 4months roughly but she's ignoring my txts now. I have proof via txt that she said she'd pay the money back in 4 weeks, 8 weeks ago...
Can I use that txt as like written agreement that the money was owed in a small claims court or something?
Or my other angle was to chat to her mum as we got on well ... or is that a no go? Don't really have a clue what to do or what I CAN do..

You could chat to her mum but she may say it's between you and your ex. Try Citizens Advice but small claims court may be the way to go.

Ok thanks for the reply. I havent mentioned to the ex that i still have the txt she sent, recon I should make her aware of that first to see how she reacts?

Me to, put it down to experience or think of it as £500 to get rid of her.
At least its not dividing a house up or custody of children.
Never lend money you want back without a contract.

Tell her you will send all the private pictures you took of her to her friends and family unless she pays you back :grin:,there is a term for it but I cant remember what it is :undecided:

This bit I will deffo remember in future. One of our 'mates' borrowed loads of money off people in the same friend group, about £800 between us and f**ked off to Magaluf!! Some people need putting down.

Grow up -it's is nothing to do with anyone else. Small claims court will cost around £50 to reclaim £500. Citizens Advice will provide forms, it's a simple process and very informal and you do not have to use a lawyer to represent you.

As someone else said, it's £500. Yes it's a lot of money, but it's nothing compared to what you would be dealing with if you had a house and kids.

If all it takes is an hour long talk with the mum, then he has earned £500 an hour. I wish I made £500 an hour.

I see your point but the fact is she used this money to make more money, and bringing kids etc into it is completely irrelevant to this situation.
I find it crazy to find people can consider just brushing it under the carpet!! £20 maybe but not a weeks work!

Involving someone's parent is not immature..
Cleary she has refused to pay back the £500 that she has borrowed. Before taking it to the courts, why not merely ask the person who you would assume she respects to have a word with her. No one has said go round to the mothers house and steal £500 worth of stuff...
Does a mother not have a responsibility to ensure their children uphold moral values.. like I don't know... not stealing??

He's what you do.
You write to her via recorded delivery that you will give her 7 days to pay back the money. Failure to receive the money by then will result in you "having no option" to take her to the County Court. (Small claims court is part of County Court)
For a small outlay (£50-70) You can do it all ONLINE.

Explain in the letter that it's in her best interests as based on the "Tex message" you have, your "lawyer" :rolleyes: or CAB etc.. has advised that your claim is strong...and that judgement in your favour will affect her credit rating and ultimately cost her more than £500 (add CC Fee and your costs, travel etc..) + Bailiff
You can, if you win and she won't pay, enforce a:
1) warrant of execution
2) attachment of earnings order
3) third party debt order
4) charging order
Then, if she ignores you. File the claim. If she doesn't show up in Court, you win.
Don't be afraid, it's not like Rumpole of the Bailey. Just you, her and a guy in a suit around a table.
The worst that will happen is you lose the £50-70 court fee.The best is that you get your money back.
Trust me. When those official Court Summons appear on her door mat, its amazing how it focuses the mind. Probability is that she will pay up immediately.

Had a stroke of luck this morning tho. Yesterday I called her best mate and explained the situation and she was wholely on my side and said she would speak to her. Turns out my number was blocked so she never received the messages. Here's what I woke up to:
Hi sorry I havent received any contact from you becasue your numbers been blocked. I have every intention of paying your money back it just hasn't been my priority atm, which is wrong so I apologies about that. I can set up a standing order and pay monthly or I can find another way to pay in a lump sum by the end of the week. Let me know.
We agreed on the lump sum :) Happy days!

Yeh I see where you're coming from but I have a feeling she wants to get this done and dusted and just move on. The blocking would have been because we were terrible for splitting up an getting back together all the time. I had her blocked until I sent the first txt about cash etc.
