i need advice from you guys.
i was reverse parking (checked all my mirrors) parking on the left hand side
anyway checked all my mirrors and checking the left hand side.
next second i felt a bump thinking wth have i hit,
anyway check my mirrors & theres a red bm parked there trying to do a 3.turn. (hit his driver side wheel)
as i got out my car, a walker by calls the guys name & asks are you ok
checked the damaged & i hit his wheel & my bumper has a tiny scratch
now this guy says i hit his wing but there aint no paint transfer but paint is missing from my bumper. (his wheels where kurbed bad & the scratch is rough not smooth)
he tried to get me to admit fault which i refused saying both of my reverse lights are working & you shouldav seen me.
now where do i stand people?

So, you were reversing, and he drove behind you, while you were reversing... correct?

So, 6 of 1, and half a dozen of the other! was it on private property? admit nothing, and ask him how he's going to pay for damage to your car, leave the ball in his court

i have edited the original post (much more clear)
it was on the main road.
he said that i got to pay him (1st time this has happened to me in 7 years lol)
spoke to my mate & he says to ring the insurance & tell them what happened & also say that his witness knew his name before hand
p.s his car looks nice from far but close up its a different story (thats what my mate said to me)

If you were doing your maneuver first you could argue that he drove into you. Insurance will probably go 50/50. Tell the guy to go through his insurance and pay excesses or try to come to some sort of agreement.

yeah, i was doing my manouver 1st as when i checked my drivers mirror nothing was there all clear, then checked my rear view mirror & then pas mirror (was parking on left side)

It sounds too convenient that a friend happened to be walking past, it screams insurance scam to me.

Im saying its his fault & he should be paying. As when i checked my mirror it was all clear & good. Then a bump. He shouldav seen me reversing as both of my reverse lights work. So he owes me monies

but, did you continue to monitor your mirror if that were the direction you were traveling?

How is he asking you for payment, by phone, face to face or by letter?
If not face to face then ignore him, don't communicate one bit.
If he then goes to his insurance company and they contact your insurers then deny everything.
Toughen up and let him do the work.

Golden rules of any prang/accident on a public road.
1. Admit to nothing
2. Exchange addresses. (mobile number as well)
3. Give insurance details (usually by phone afterwards)
Do not say anything else!
Name rank and number as the old saying goes

Oh I should add the above rules only apply if there are no injuries to a person.
Injured parties require police notification.

And to add to Len's advice - take photos on the scene if possible (Len's a bit old to have a new-fangled mobile phone with a camera on it, isn't he? :whistle:).
Although not if taking photos is going to get you roughed up!

ye did all what you guys have said. It was like he wanted me to admit fault. Spoke to him face to face. Took pictures aswell.
P.s i was monitoring my rear view mirror & my passanger mirror. It happened so quick i thought i hit a brick. Then i checked my rear view mirror & nothing but when i got out the guy is stood by his car saying what you doing. So told him trying to park. Lol

sounds like a 50 50 claim tbh. i'd tell him you will go through insurance if he really wants to pursue it but you will both lose money and no claims. basically sort out the damage yourselves. he needs a new wing you need a touch up pen. sorted.

All good advice above, just to add though, notify the Police that a minor parking bump has taken place, and stress no injuries were incurred, make clear that you believe that the accident seems suspicious, be prepared to provide you documents, because they will ask! Police will also ask the other driver to do the same, this should sort out whether he's legal or not! and as already said, dont admit to anything
Then if its a genuine claim, let the insurance company fight it out, this is what they are paid to do...

if you are saying its 50 50 then might aswel leave it there then. No point loosing nbc over a scratch even though i want him to sort the bumper out. Over the head now.

Personally he hit your rear! So hes at fault in my eyes, he came in your path of driving, that would be like someone in a lane next to you driving into u and blaming u for "being in the way"

Remember you have no right of way when reversing against traffic, therefore if you hit someone going backwards its technically your fault.
Its up to you (your insurance) to prove he was being negligent or dwdaca to claim as non fault.
This is why your best outcome from this point is a 50/50 knock for knock as it will be difficult to prove otherwise.
With the odds stacked in his favour I would expect a whiplash claim in the post over the next few weeks, unless he has something to hide or is a genuine sort of chap and will settle with private fix and shake on it.
Even if you settle out of court so to speak you will be liable or can claim for personal injury for I believe 5 years (someone correct me) which is part of the reason you are asked this at time of policy application....
With scams being at the level they are these days (encouraged by no win no fee) it is best to get the old bill on site asap if you smell something fishy (make sure you are legit, ie cat bypass etc etc**).
A post accident report is just an A4 piece of toilet paper, you will have the fuzz on site if you report alcohol on the breath over the phone.

Worst case, you both pass a breathalyser** but get an accurate report of the scene as it happened (and a pissed off plod with a big report to write).
Best case he gets rumbled.
Even if the police and insurance think it is a scam (as in my case) proving it is a different story, so you may still end up with a claim against you but with dramatically reduced costs as speed conditions and immediate damage and injury will be assessed by the police and not affected by a post crash hammer.
Scams are made more effective because we treat minor accidents as run of the mill and just report what we see, which is generally what the scammers have planned.
It bad enough that the insurance and solicitors exploit claims for non existent injury just because its a legal sure cash win.
Insurance laws breed recidivists like a pond breeds scum.
It is always best to go through the insurance as this will protect you to some extent, although we have all been tempted at least to do otherwise.
I hope and believe this is a genuine accident which will not get to overblown, there are still some decent folk out there but it always pays to be suspicious :grin:

Not necessarily, as he were reversing.
'Driving next to you in a lane' etc is different as he wouldn't have been reversing.

this is an absolute waste of police time and tax payers money, far to many people use the police to sort out civil matters. Police will not record speeds or do recon work for non injury RTC's and should not be called to an RTC under the false pretence of smelling alcohol

THIS.
A report will only be compiled if there is personal injury involving drivers/passengers/pedestrians and believe it or not, some animals (namely livestock) OR if there are obvious offences.
Other than this, there will be a reference number for the 'job' of them being called out, and you'll be told that it's a civil matter. They'll make sure that the correct details are exchanged and that there is no breach of the peace.
