Title: charge notice advice

wouldn't mind a little advice on a "charge notice" i ve received in the post today

whats best thing to do as not had one before, i think i understand that Parking fines in private car parks are based on contract and there is no requirement in law for you as a driver to disclose the identity of the driver.
Without this admission the parking company cannot take any further action as they need to have somebody to actually sue - namely the driver for breach of contract. well think that's right but whats the bit marked in red mean has the law changed ?



any advice would be great as don't want to fork out £50 to these ..... lets call them people

Sounds a bit daft but why didn't you leave before the time allowed for fee?

Pretty sure if it's a PCN (Parking Charge Notice) then it is non enforceable. Do not reply if you decide to stick to your guns, and just ignore it, check moneysavingexpert for people like excel parking etc, there is a thread on there showing all the letters you can expect to receive.

I got one from these people, got two letters, ignored them both that was 3 years ago  :whistle:

Agree. Bin it and ignore every follow up letter. They'll soon stop.

The new legislation basically protects the driver/owner from bing clamped or towed in a privately run car park, or on private land, they can issue a charge notice but how they expect to get that fee is behond me when like you say they don't know who was driving and you do not have to say?. I wouldn't think they would take it to court as of the above and also the fee would out way the charges, I think, I am right?

The new legislation is more to do with stopping clamping and making sure private car parking companies don't take the piss and making sure they abide to the law when ticketing.
I couldn't see anything about you having to pay, so it should still only be a breach of contract - a civil case.

file it safely in the bin.    all they can do is bleet at you  file those in the bin as well

my "dog"  eats all that sort of mail i don't want to recive unless t was sent recorded delivery

i think we're missing the important question here
what on god's earth is so interesting about a MOTO service station or any for that matter, that took nearly 3 hours?  :grin:
