I cant seam find clear cut points on things. I was curious what is considered of road? I have a parking for residents only. It has a sign for the spaces they are just off a public road. They are accessed straight of a cul de sac road, the flat is a council flat spaces for the flats but are not allocated to a pasific person or numbered.I wanted to know what is acually classed as off road for sorn purposes.
Also I was curious how long before i get a warning or fine when they see car isnt insured anymore on database, has anyone been in that situation? car is still taxed but cant cash it in until get v5 i havent sorned it yet.
I got a old mondeo in good cond at below scrap value so was going to mot it as cant see not probs and has 99k and have a groupon mot voucher to use, but realise cant even drive it there legallly there if isnt insured. There so many rules since that new must be insured rule since april 2011. Shame v5 takes so long to come as would of had 2 months to cash in.
Also i was wondering if i mot it now long can you still use it until mot runs, it has 20days left mot booked on friday.
It is annoying they make you sorn it now, and cant keep tax unless insured makes buying and selling a few cars really hard work, no wonder old cars get scrapped so much with all this hassle. Thanks :cool:

yeah lost/confussed me mid way. you on about claming tax back on a car thats sorn?
Or something to do with it isnt insured how long till its towed?
If your buying and selling a few cars, isnt trade insurance and trade plates a good way forward

agreed i totally messed up that post was to rushed and worded it wrong and spelt stuff wrong, hopefully a little better now, it hard to explain, i havent slept much either :cry: even i couldnt understand the 1st half :laugh:

i looked at temp cover and best could find was ecar for 167 quid :shocked: for a months cover, mine like 35 a month at moment but cant use no claims on temp cover, so guess il have sorn the car until sold it, depends if they warn you before v5 arrives? that what i wasnt sure how long the dvla take to take action.

Basically to Sorn a car it needs to be off a road, ideally on your own private property.
If you live in a block of flats and you leave your car on private land, such as the flats car park, it technically not your land and someone could report it and it can be fined or taken away. So I would not chance that, best thing to do is tuck it onto a friends drive if they have room and do not mind or get a garage to store it away.
Once your vehicle is sorn and off road it no longer requires insurance, but if you wish you can still have it insured even when sorn.
If your tax runs out and you haven't declared it sorn the DVLA will usually write a letter to you within a week or two, usually they give you a chance to sort things out ASAP with discretion or they will fine ya a$$.
The new rule in april that you are on about states if a car is left on a public road it needs to be insured, even if its got tax it still needs to be insured, otherwise the owner would have to sorn it and take it off road, as people will just get a car, dump it outside and never work on it etc...even though its taxed but not insured.
You can drive the car right till its final MOT expiry date, I've done this on a few occasions, but I'd always make sure its ready to pass the MOT if I do this by popping to my mates garage and doing a MOT checklist with him.

You need to be careful. Just because land/road is privately owned it does not mean that the road traffic laws do not apply.
If the public still have access then in most cases it will still be a road. The definition of a road is "any highway and any other road to which the public has access and includes bridges over which a road passes".
"other road" includes footpaths, verges, bridal ways etc.
If the carpark had gates with tag entry that only residents can use then it would not have public access so wouldn't be a road.
So a carpark that everyone can drive into would still be a road regardless of who owns it. So in this case you would still need insurance and MOT. Im not sure if you would need Tax however if its not maintained by the Gov.
To be sure you would need to look at the wording of the laws you are worried about breaking and then look at where your parking it.
