Iv worked a 2 weeks in hand.
What is the deal. If i find a job which req a imediate start, and i know that i have 12 days holiday.
Can i use my holiday as my notice to start my job asap?
Will look at the company contract tonight.

Did you have a contract stating anything to begin with? Is the amount of holiday you have correct, and offset for the amount you have worked this leave/holiday year? My missus is on holiday now after her last day on Monday. She thought she had 16 days holiday but only has 9 due to the fact she is only a third of the way through her leave year.

If you've already handed in your notice and you have accumulated holiday, depending on how contractually it's calculated (1.5 days earned per month for example), then you should have already discussed what to do with earned holiday.
Companies can pay you what's owed if they really need you to work, or you can take holiday during a notice period.
A notice period is just that - a period of time served in which the company know you're leaving. You can during that period do the following, turn up, go sick or take holiday.

Asked today, 11.5 days holiday + 3 bank hols.
Not handed it in yet. As theres no job in stone!!
I just dont want to pass a job because iv already got a job etc..

well if you get the job hand in your notice if they say you must turn up to work try put holidays in, if they dont let you/you dont have enough just take unpaid leave...i.e dont turn up, they wownt pay you, but what are they going to do? fire you? youve already handed your notice and started your next job :smiley:

this is not a good attitude. what if the new job doesn't work out? maybe a few years down the line there maybe a better position within the company you want to apply for?
whether you hate the job or not i'd always try to leave on good terms. My missus has just started a new job. she hated the company she worked for but was always professional and did things properly. The result is they'd have her back in a heartbeat if they could and have clearly stated this.

i didnt say go in and piss on your bosses desk, i said hand in your notice and try and take holiday if needed or unpaid work, if he cant do that what else is he going to do, give up the job he wants for a job he doesent want to do anymore. chances are your boss would let you take holiday / unpaid leave. however i know if my boss wouldnt let me i wouldnt be ringing up a guy whos taken time out of his day to interveiw me and offerd me an oppertunery which is hard to come by in today economic state i.e. the job i want to say no ta. ide maybe ring him up and ask if i can start in a few days time after your notice has been fully worked of, but if the job was available for starting in a few days/weeks then the job wouldnt be advertised as immediate start. just my personal opinion.

my issue is with this bit. New employers understand that notice periods must be worked. they'll probably pay any outstanding holiday and a notice period will probably need to be worked.

well if the new employer understands that and lets him work his notice then great, however as i said before if my boss didnt let me have the time off by putting in holidays and the new job i HAD to start by a certain time, i wouldnt have anytrouble not turning up to the job your loosing, as i said i wouldnt be saying no to a job i want to keep the guy at the job i dont want happy. but guess we will just havbe to agree to disagree
