If I buy my car back off the insurance if it's a write off will I still have to pay my excess?
Also if the guy in front of me slammed on for no reason apart from he 'thought I was too close' and I went into the back of him is that still my fault? I'm guessing yes as I should have been further back.
-
Have you got proof of him saying that in a statement?

Not sure what he put in his statement but he yelled it to me and then to my dad, I was crashed into after I crashed into them and then somebody into them as well after so a 4 car crash :/
-
think it would still be your fault :undecided:
as for buyin back the car they will just take your excess off any money to be paid to you if they write it off
-
Why did he slam on? Was he brake testing you because in his opinion "you were too close"? Or was he approaching a braking point on the road / slowing down for a junction etc...
If he deliberately slammed on then he is guilty of causing an accident and you should report it to the police immediately.
DO NOT admit liability for anything in your statement to your insurance company.
-
Oh!!!! I assume the old bill attended? Find out what he officially said. If he did say he slammed his breaks on because he thought you were too close, you might have a bit of an argument, he's kind of admitting he caused the accident? I don't know...

He slammed on because he said I was too close and I won't do pal
-
In that case, you must report it to the Police. This will help you should your insurance and his insurance start pi55ing you about.
Regardless of how close or far you were from the back of his car, he wilfully and deliberately caused a road traffic accident. Plod don't look kindly on these things.
I hope you took some pictures of the incident and his car? This should demonstrate that he was not slowing down for a junction etc.. and support your contention that he was brake testing you.

yes, but if he did say that hell change his story very soon no doubt.
sorry bud but insurance look at rear enders as, 90% of the time the guy behinds fault. as you said, you shoiuld of been further back. thats how its going to be seen, its basically always the person behinds fault

My landlord who worked in insurance claims told me that the insurance of the last person to crash is responsible for everything in front of him. but if he did a slam on for no reason you and everyone else involved can claim from his insurance.
-
well at least you will leave more of a gap from now on

I got done in a contrived accident, I rear ended a lone guy in front at very low speed and after a few weeks got 2 whiplash claims...
Insurance investigator got on the case and got the other claim dropped, but as I had no witnesses and cctv was looking tuther way they still had to pay out but only the bare minimum.
I now leave a bigger gap, keep my speed down and my eyes on the road

thats bull
if you are hit from behind, and then hit the car in front, its you thats responsible for the car you hit...

If I hit someone and push them into the car in front of them it's not their fault! How can they be at fault?

Generally goes knock for knock in this situation, but could still imply you were too close to the car in front or driving without DCOA.
Tough call
-
Dad had exactly the same a few years ago. His insurance had to pay out for 3 other cars as we got rear ended, knock on effect etc. And the bloke behind drove off. He was at the back.

Regardless of why he braked, you should have always left a big enough gap to allow for your reaction time and the braking distance.
Life's a b!tch I'm afraid!
You'll definitely leave a bigger gap in the future.
-
All this bigger gap. If he was that slow that's what the right foot is for  TO THE FLOOR!!!!

Not Bull, most insurance companies now use this system for claims, it makes complicated claims simple to sort, making "knock for knock" redundant in most cases

my work mates brother was in a very similar accident. He was in a 4 car pile up. he was the 4th. He see the cars infront of him hit each other and didn't/couldn't react fast enough and hit the 3rd car.
They all claimed on his insurance
-
Which is why that claims system is cr4p cos he was only responsible for the car in front as the others had already caused their damage.
Can't think of another example of law applied this way :undecided:

I get sick of twits driving up my butt when I am doing the max speed limit. Ive even experienced kids doing this with an open road in front of me where they could overtake and they dont. It is plain stupidity and anyone caught doing it should lose there license and get beat up at the police station.
