So I bought a Punto for £225 quid with 66k on the advert and the clocks.
Stuck a headgasket on it and sold it for £950, private sale. The guy has come back round my house demanding his money back saying the car has been clocked. Well I have told him to leave while I try and find out why and when it was supposedly clocked. Well he left the car and the keys and said he'd be back.
Wasn't aggressive but was firm, which is fair enough.
Where do I stand? I don't think it's been clocked but he seems to think according to previous MOT's it has been. I haven't got the certificate to check or the logbook. I will be asking for the certificate though.
I knew nothing about it and to be honest I don't think it has been clocked, it drives pretty sound, not too rattly or anything looks clean. Do I give him his money back or what? Obviously I will be checking the history and if it isn't clocked tell him to do one.
INB4: You didn't check it before buying blah blah blah, it was £225 I spent £30 on parts, I didn't bother witht he hassle.

Well now you know to check the history no matter what, you can then add that to the price along with the report
-
Did he not think to check the history himself?

Well that's my thoughts. His evidence is he says he's checked the history by his MOT tester mate or something.
Tbh, no I didn't check the history, nor did I look at the car before handing over the cash as I just bought it from a mate (Nissan dealer) as it was chucked in as a part-ex.
-
Sounds like you'll be doing this regularly so might be worth checking the history to save yourself the agro later on.

2 Golden rules of the Motortrade! (1) NEVER buy a Fiat (2) NEVER EVER buy a Fiat to sell on, every single time, It'll come back to bite you! lesson learnt

how many miles is he suggesting it's been clocked by?
-
since 2005 all mot info including mileage is held on line need the reg number and either the doc reference number from the v5 or the current mot test number and then it the mileage can be confirmed back to 2005. Its a great tool for selling cars with no history that along with a hpi report covers you against selling a clocked car if you dont have the fulkl history as you have done all in your power to check. I would just refund him as if the buyer believes he has bought it from a trader ie some one who has made a profit from the sale and reports you to trading standards could get messy
-
Yeah I mean this was just a private sale though, IIRC can do 7 a year?
I do trade as well but this one was just a private.
Cheers for the advice, may just cut my losses, refund him ,try find the correct mileage and sell with "replacement clocks" or somehting.
Edit: Apparently it's done 100k or something. Just text him for the numbers I need to check online.

tell him to f.uck off he should check before he buys it.. what a tw4t.. grow a pair and close the door on his face.. If he has no proof what you gona refund for ?? also why didnt you check whats wrong with you aint you a mechanic ?

Nah, I bought the car with a blown headgasket, stuck on a gasket and car was sweet as.
I will do but obviously if it is clocked I will be offering first a partial refund. I will be checking online history myself though.
-
you can check on direct.gov website but if your a mechanic you can check mot history at work no ?

Yeah can do when I get an MOT certificate AFAIK, I don't actually do MOT's but the station we use will be able to tell me. :)

Funny enough, that's exactly what I'm thinking.

Selling as an innocent private seller you not obliged to do anything unless you said it was genuine miles.
Selling as a car trader he's entitled to the difference in "book price" between the two mileages.

This.
It was a private sale. Therefore Caveat Emptor!
Unless you "Knowingly misrepresented the mileage" then your buyer has no comeback.
You can tell him without fear of redress that you honestly believed the car was "as it is." Jog On Kitty!
Up to you if you want to give a full refund as a matter of goodwill. This may be the best option as word gets around, and you don't want a dodgy rep in the motor trade.
-
then wait for more damage to all your cars parked up near your house :lipsrsealed:
-
So I have had the MOT history checked by my MOT station and there is no indication of it being clocked. No MOT's are over 65K miles.
Told him to politely do one. Apparently "oh it must have been a mistake". Yeah, I'm sure you were mate.

I bet he got this for his son/daughter , first car then realized they can't get insured. So thought I try my luck on returning it.

Yes. It is against the law for a Trader to do so.
