Driving home last night along a unlit single carriageway around 11pm. The road starts off at 40mph then changes to NSL after a short while. I had passed the 40mph section and was slowly increasing my speed to around 55mph.
As I approach the first slight bend I notice in the distance that the car coming in the opposite direction has what appears to be spray in front of its headlights. Approximately half a second later I hit standing water... LOTS OF IT!!! the car aquaplanes and before I can do anything I have spun about 30 degrees and smacked straight into the kerb. At this point I have water gushing over my bonnet, so I am assuming a burst water pipe.
I manage to get the car back onto the road, straightened up and drive home (with a horrible scraping noise). The rest of the road is a gradual down hill, and no one is managing to drive over 20mph as water is still spraying up and over the bonnet and virtually flooded by the time I got to the bottom of the hill.
Now looking at the car the front left side wheel is fcuked. the front bumper is bent i.e. hanging off. So my question is 'who is to blame?' will i be able to claim money for the damage back from the council/water company or will I have to foot the bill myself?? :cry:

ive been googling this and cant find any info, it's a tough one because it's 'act of god' so should be insurance but at the same time you had no flood warning signs so the council f'd up too :undecided:

I have a horrible feeling you may have to foot the bill yourself or go through insurance a few years ago my friend hit standing water in a slight dip that couldn't be seen (after heavy rain) cuasing water to flood in the the engine (it was a MINI ONE D) it completely killed the engine she ended up going through the insurance who pulled a face at using MINI but when she asked about warrenty etc as the car had the TLC pack they relucently sent the car to MINI for the repairs. When she rang the police they said it was not the problem it was down the highways department

well i disagree and i think it reflects on the sh!tty attitude this country is inheriting from america with regards to the 'its not my fault, give me money' claimers.
End of the day if r32uk was a better driver he wouldnt have a f**ked car.

could be the best driver in the world an still have a bump but i kinda agree if he was driving at a suitable speed for the road conditions maybe this wouldnt have happend i.e u wouldnt tear down a motorway at 70 if it was covered in snow

A damaged wheel is the least of my problems I have possible over £1000 worth of work to pay for through no fault of my own. The road was unlit despite having new lighting every 40yrds or so. I also have xenons which light up the road better... but as it was on a bend and water was to such an extent the road looked wet... not flooded like it was.
Once a car aquaplanes there isnt much you can do... what would you have done smart a$$ :rolleyes:

Sorry to hear about the damage. You will have to go through your insurance for this one and if they think they have a case to fight they may pursue it. If they do it will take time, either way you still need to get the car fixed.
I presume you would need to go through the insurance to get the work done?

Dont take it on the chin, why should you be out of pocket because some bellend cant do his job properly!? (lighting on the road, sign saying there is a flood / water pipe leak / actually fixing the leak)

I hit a fox in my daily, busted up my bumper badly.... I wanted to take the fox to court but I cant because his lawyer tells me he was pronounced dead at the scene... gutted! (true story bar the last bit)
On a serious note... I hear what you're saying and by all means try and contact a water company if that's who caused the water... However, bare this is mind, The leak may have just happened, were you the only person that lost control of your car and how come others made it through without crashing?

The traffic coming the other way would not of had a similar problem as they were coming up the hill. I imagine there were quite a few people who encountered problems... as it was late I could only see one car quite some distance in front of me and he/she had their hazards on and were doing 20mph like myself. 50m or so down the hill there was a car pulled up at side of road also with hazards on.
I can only speak for myself on this one but i imagine if i had been doing the NSL (60mph) and had caught the water with a car coming round the bend at the exact time it would probably have been a fatality.
I have hit potholes before and always taken it on the chin... but this is the water company that is to blame, its as simple as that.

misread that, if it's down to fault by the water company then speak to them, but if it was a pothole i'd take it on the chin as you should of read the road and seen the pothole and taken the right action to not hit it

thought you meant a burst pipe in your engine bay! if it's a burst water mains then deffinitely get onto the council / water company as their property caused damage to yours

i dont think brakes come into question when you hit deep water on a bend and begin to aquaplane :huh:

Im nearly 100% sure that the water company will have disclaimers for stuff like this and they will deal with the highways agency who will hold these disclaimers.

Just to clear a few things up...
The burst pipe was in North Leeds
I was driving the mazda (so not 4wd) and even if it had been not much you can do when you aquaplane. Keep up Jay :grin:
Was doing around 50 - 55mph
There was so much standing water it was sraying up over the bonnet
The utility company is still there now with JCB and 2 trucks and lots of flashing lights fixing it. The road is still wet despite it being 22oC outside
Spoken to solicitor and waiting for him to get back to me.... :nerd:

I was driving the mazda (so not 4wd) and even if it had been not much you can do when you aquaplane. Keep up Jay :grin:

If it is as described then you have to think about these things.
Its dark and an unlit carriageway. So if there was water up ahead, you wouldnt see it unless you have full beams on.
He probably didnt have full beams on as he mentions a car coming the other way.
He was doing 55 in 60 so not light speed.
There was no warning, or signs.
I think we would have all done exactly the same thing here probably as i cant see how, other than sixth sense you would know it was there?
On the flip side, if a pipe bursts and floods a road. The water company/council/highways/police cant be everywhere instantly.
The pipe could of burst 5mins before or 2 hours. If nobody reports it previous to the crash then nobody will fix it.
I have no idea if you can claim from the water company but think you would be doing well to get some money out of them! If you dont try you dont get!

Couple of things worry me about this.
NSL in a lighted area with a kerb. That is not standard practice.
As for the driving he saw spray ahead and did either nothing or next to.
Which lane were you in? If inside did you consider moving to outer lane where water would be shallower?

He said it was unlit in his first post. He also said he hit the water half a second after seeing the spray. He also mentioned it was a single carriageway, so i hope he was on his side of the road and not going for a head on into the car coming the other way.
Also local to me i can think of a few national speed limit, single carriageway roads with kerbs and foot paths that run for miles with no street lights.

Not being picky Len, promise! :) But even if you have F1 Driver reaction times, half a second wont stop you from 55mph or even get you on the brakes to slow you to half that speed.
Of course everyone is different mind. Age, fatigue, cars, road, weather etc all play a part.
Let's start with the basics. A vehicle traveling at 60 mph covers 88 feet per second. But stopping that vehicle takes over 4.5 seconds and covers a distance of 271 feet. Why? Because there's more involved in braking than the actual time your brakes are applied to the wheels (called "effective braking"). In particular, "perception time" and "reaction time" add considerable distance to stopping your car.
Perception time is the three-quarters of a second it takes for you to realize that you need to brake. Reaction time is the three-quarters of a second it takes to move your foot to the brake pedal. When you combine perception and reaction time, a full 132 feet will pass before your car even begins to slow down from 60 mph. So from the time you perceive a braking situation until the time your car comes to a complete stop, a total of 4.6 seconds elapses. During that time your car travels — it bears repeating — a total of more than 270 feet. That's almost the length of a football field. Of course, the faster you go, the more time and distance it takes to stop.

this forum is looking less like "here's my helpful advice" and more like "this is why you're wrong and it's good enough for you".
I understand the help and sarcasm, but the help has gone quiet and the sarcasm has turned into just being a dick. with 0.5 seconds to react and stop, I challenge anyone to not damage their car. he couldn't even slam on the brakes as he was on a bend and either way he's still going kerbside.
if you read the OP and title, Mr. R32 is simply asking if he has any grounds to claim some money back from damages caused by an accidental flood. it's a yes or no question.

Within seeing something that MIGHT need braking for, whilst you are still accelerating and not expecting the hazard...
It takes you more than .5 seconds to THINK "i need to brake".
Then take your foot of the accelerator.
And then hit the brakes.
And of course, even if you did manage that. You are still doing 55mph and the OP states that in that .5 seconds he then hit the water.
Of course the OP could be exaggerating figures but going on what he says, it seems unlikely he could of got on the brakes, let alone brake enough to mean he wouldnt skid into the kurb.
Or that is my take on it anyway.

Indeed, there is a huge difference in braking ability on the road but we cant change that even with a scrapage scheme!
Point im making which you are fully aware of is .5 seconds isnt enough to even get on the brakes regardless of your car.
Think my replies have dismissed all of the doubt!
Back to getting money out of the Water company... Good luck! :grin:

I believe Clarkson makes sense when he's Standing next to a Merc/McLaren SLR and Says these Ceramic Brakes stop me in half the distance of said 'stopping distance' That means... I can go twice as fast! :evil:

As I said the car was aquaplaning long before I could brake... it was 22oC yesterday an not a cloud in the sky. The last thing you expect is to hit 3" of fast running water.
As for slow reactions... I am pretty quick... well quicker than that old dog Len thats for sure. :lipsrsealed:
Anyway back on subject:
Spoken to Yorkshire water and they say they do have a claims process in place, but first must look at the job reports to see how bad the burst actually was and if it would actually have caused any problems. Been told to expect a response within 10days approx.
It must have been pretty bad as they are still working on it this evening.. and it is one of the busiest stretches of road in north Leeds.

I have taken pictures of the damage to car.. although most of it isnt visible. Garage are also being very helpful and will take pictures once front bumper is removed etc. Didnt manage to get back there last night to take pictures but got some of the work being carried out. It was also mentioned on Galaxy radio and the inconvenience that has been caused. So it was obviously pretty bad.
Just waiting to hear back from solicitor also... if required I will be claiming for a hire car and all associated costs etc

its an 07 plate Mazda 3 MPS... which gets you quite a bit of car for the money, 265bhp, xenons as std, Bose stereo, half leather seats, 18" wheels as std. Its in silver with factory fitted tints all round... so unless you know whats under the hood it doesnt shout out like most hot hatches out there.

Begs the question why you have that and a Mk6 GTI? Very similar cars.
I dont have the Gti any more.... it went a couple of weeks back. Im now in a nice 7 series BMW whilst the mazda is in for repair. Sooo nice to drive as I did a few motorway miles today... But not great for me on the whole as I am usually just driving around town. Quite nice to just kick back and pump some tunes on the logic 7 stereo... its like being sat in an armchair at home :grin:

I cant say i have browsed 7 series for a replacment for the Type R although i have looked at the 3MPS Mazda and the 3 series bimmer!
All very tempting.

I dont have the gti.. as stated above. I just stole my dads car.... he stole my mums car... and.. well, my mum doesnt really go anywhere :laugh:
