Hi guys last night i was on a night out with my work mates and ended up getting my phone stolen.
Somebody has asked to borrow a call... so i did (stupidly) they have then bolted off with my phone.
I chased them to an alley were he pulled a knife on me or at least pretended to im not sure and wasnt willing to risk finding out.
Anyway, then he ran off again so i chased him again cos i was very p*ssed off i caught up with him and got him to the floor and in a head lock but then his mates arrived and took my phone off him and did one with it. Eventually i let go of him and he ran off but shortly returned with a bottle in his hand. Fortunately for me the police arrived and arrested him.
Hes currently locked in a cell and due to appear in court. I have given a full statement.
My question is will i have to appear in court? I really do not want to and i can hardly remember much of what happen as i had had a skinful (it was a colleagues leaving do).
I dont want to appear in court and i dont want this to go any further because i have enough to think about right now. Im not that arsed about the phone i just want to forget about the whole thing.
So yeah, if anyone has had any similar experiences let me know.
Thanks
Ryan

hi sorry to hear about the phone mate, where abouts are you in lancashire as there has been alot of people around my area getting stabbed for there iphones, the f**king horrible scumbags who need to have there hands chopped off
-
sorry to hear about the incident, whether or not you want to appear in court I guess is up to you whether you press charges... however.. is it not your civic duty to make sure that this individual is prosecuted and is pulled up in front of a judge? you never know... it might make him think twice before pulling this stunt again, injuring, maiming or fatally wounding someone. or are you going to let the scum continue to get away with it?

hi there, right i'm pretty sure this is street robbery? therefore since the police are involved and this thingy bag is in a cell then its down to the cps (crown prosecution service) as to whether he faces a court appearance in which you will have no choice but to attend to give evidence, i hope the dirty scumbag gets the book thrown at him aswell as im sick of hearing about these theiving f**kwits getting away with this kinda sh!t
mick
-
witness protection act, tell them you are feared for your life and they should just do a line up and you can pick which one it is and they will prosecute him without you going court,if its a magistrates there is probably a chance he will get a slapped wrist if its crown he is going down for 18 months+,and i hope its the latter lol
-
street robbery is street robbery mate regardless of whether he goes crown court or magistrates?? if found guilty of it he will be facing a prison sentence
-
not really it depends if he has previous,if it his first offence they will slap his wrist, and with the prisons in the north west being well overcrowded, just hope he gets raped like davis of that film scum when he is in the green house
-
thanks for your input guys but im still unsure whether i will have the choice to go to court or not.
i just want to forget about the whole thing its ruining my weekend
-
You will only have to go to court if you are summoned to appear as a witness.

This wont go to court. The CPS will drop charges due to lack of evidence and then send the little scrote on a well deserved holiday to the caribbean due to the violation of his human rights and the stress that he has had to endure.

When ever I give a statement to the Police after a robbery. I am asked would I be willing to attend court? Did they not ask you this when you gave your statement?

no they didnt ask me this... in fact i told them i dont want the hassle of court
they pushed me into making a statement though
apparently hes pleading not guilty... im guessing there isnt going to be enough evidence for CPS to go ahead with anything?

lol it's not a hobby. We have had quite a few robberies (cats cut off, radios nicked) at the site. we have CCTV. So when I report it the police come and take a statement,

Why did you lend your phone to someone you dont know ? :undecided:,anyway it would be a little difficult for the courts to Prosecute if you dont give evidence.

yeah i know it was stupid thing to do i just gave him the benefit of the doubt at the time
hindsight is a wonderful thing
-
Also he my have pulled the knife at you there and then :/
-
Doesn't sound like a robbery, sounds like a simple theft.
If he is charged he is given a first hearing date, where he pleads guilty or not, if he says not then they adjurn for another date to get more evidence and witnesses. You will be asked to go to court to give your statement.
It may sound like a lot of hassle, but if it happened to someone else and you heard about it you would want them to get the punishment they deserve, if you don't go to court when asked then he will be released, and no doubt just go and do it again. Don't give him the opportunity,

why not speak to the police and get proper advice?
you might find that as you gave him your phone in the first place that you're f**ked, as a clever lawyer could probably argue that you assaulted him after willing lending him your phone :undecided:

One replied to him the post above yours
Also, not a chance in hell that any solicitor would get that argument home. If he lent him the phone why did he run off, turn around and threaten to stab him. He gave the phone on the drunken understanding that he just wanted to use it, when he made a dash then he commited the offence of theft, and the OP just used his anyperson powers to make a citizens arrest, it was reasonable force, he didn't assault the thief, just detained him until police arrived.

he got 8 weeks

8 weeks is a sh!t and a shave,be out in a month,he will probably be in lancy farms or hmp preston depending how old he is,they make it so easy for them inside its like a holiday camp, bring back national service that would sort the little scum bags out
