Bit of a long shot lads, but not really sure where else to go :undecided:
As many of you know I am currently with my beautiful girlfriend Jules and we're expecting our baby in January next year. She's originally from Brazil but now lives here via an "indefinite leave to remain" VISA. That basically means that she can stay in the UK for as long as she wants.
When she moved to the UK she got married shortly after. She left her husband last year, as did I my wife, and we have been perfectly happy together ever since.
Just found out today that her (ex?) husband is going to see a solicitor about getting a divorce, and specifically having her deported from the country. He believes that their marriage is a condition of her VISA to live and stay here, so he will be able to get her deported.
I have absolutely NO idea what to do. He comes from a very well off family, so affording solicitors isn't going to be a problem for him.
Does anyone know whether there would be any grounds for her to be deported, especially as she is pregnant?

ILR is granted after 10 years continuous residence. Once you have this then you are a de facto permenant UK resident. 5 years after this you can apply for naturalization.
Any threats therefore of deportation are baseless.

Yeah, the guys an A* pr1ck. He has absolutely nothing to gain from it other than trying to make her life as difficult as possible. Messing around with us is one thing, but anything he does that'll jeopardise my kids future, I'll break his god damn legs!

If shes pregnant with your baby mate I think you will be alright without even taking into consideration all the other things. Sure you will be fine

She's still married. And my divorce has only just started.

This is almost right. I take it she was granted he ILR after being Married to her husband for 1 year. The rules are different for single or spouses. A person would normally have to have been here for 5 years before applying for ILR or 1 year after getting married to a UK citizen.
Now to put your mind at ease. Your GF should have had 2 visas, one is leave to remain (I take it she was married in this country), it's this one that is linked in with your situation and could have caused a problem. As she now has ILR you are laughing. The only conditions for this Visa is that she cant claim benefits nothing more, nothing less. She can work as much as she likes, see who she likes, be single, get married again the whole shabang.
The only negative is she could have claimed citizenship after 3 years of being married but as a single she would now (after divorce) have to wait the full 5. Unless you get married of course.
If your still worried then give UK BA (border agency) a call and they will put your mind at rest.
