Title: Chances of getting off this parking fine?

Was going Maidstone on Saturday and my mate had stuck £2 in a machine and it took his money and gave no ticket so he phones and says don't bother with the machine. Have a look around and LOADS of cars have no tickets. So I don't bother. Wait round for a parking warden, see none after 10 mins. Have no paper or pen in the car.

Come back and me and a mate have a fine, as do many other cars.

See a parking warden have a moan up and he demonstrates the machine working. He however never issued the fine.

Said we can appeal but what are the chances you reckon?

They take a photo cause I asked what if I just photoshop a ticket up (this guy was proper alright) but it's an offence to not display the ticket in the windscreen apparently. Was council, not private.

Or should I just not bother?

All depends on if the parking area was private or council run.   Do a search as this has been covered a few times that I can remember.

If it was private I'd of handed the warden the ticket, unopened with a game of hangman on it and politely left.

It wasn't.  :grin:

Surely if the ticket machine wasn't working and the person over the phone told you then that call should be recorded somewhere. I'm sure more people complained about it.

Nah bascially we didn't see any numbers but my mate phoned me.

Do a nice letter to the council explaining the situation, what you got to loose :wink:


 I got away with a fine at hanley shopping centre cus i just presumed it was free and come back to the car to find a fine on my window. sent a letter saying i was visiting the town blah blah and they let me off :laugh: :laugh:

I had on a while back as my ticket had ran out about 15 minutes before I got there. Some good Samaritan had left his valid ticket under my wiper though. I appealed and sent a letter to the council with photocopies of the ticket, yet they still said the ticket was being upheld. I suppose it depends who is dealing with it. I obviously had a jobsworth bastard dealing with mine!

If the machine wasn't dispensing tickets and there were no other machines for that car park then you have a very strong case.

Which car park was it?

the mrs had the same thing a few weeks back in canterbury sent them a letter and they told her not to worry about it

so i would send the letter in worth a shot

Remember my Dad getting a ticket once for parking (sensibly) in an un marked bay. He paid up then a week later where he parked was turned into a space :rolleyes:

One in Maidstone near the cinema but the one outside David Lloyds.

My fault in the sense I just listened to my mate. Shoulda just parked elsewhere.

I got something similar a few years back, went to the council parking office and got the parking ticket cancelled.
This was in Wandsworth in London and they contracted out to a company for parking attendants, but the council still dealt with all the tickets and fines.

It can't hurt to try, a little bit of effort. But if the fine is only £25 and it takes a lot of your time and effort, probably not worth it.

You should get off fine by stating that the machine didn't work. Better yet if you can get anyone else who got fined to write the same. Medway council, from experience, will try to reject this letter. But threatening with taking them to the independent panel will often make them brown their trousers. I beat them aged 19, so it's possible. Check out the pepipoo forums or whatever it's called. They can provide lots of useful tips.
