Title: mobile phone contracts

Heya

Im on a 24 month contract to o2 and have about 12 months left , got an iphone 3gs which i recently dropped down the toilet :(

Problem i have is that when i first joined o2,about 5 years ago , it came about by an ethnic lady calling me and setting it up, a few days after i received the phone i noticed they had my name wrong on the paperwork, so i rang them and explained this , they didnt seem all too fussed so i carried on with the contract, in fact i forgot about it really

When upgrade time came i again informed them that they had my name wrong and could they fix it, again they didnt seem too arsed by it and i signed up to a new 24 month contract , in fact i think im now on my 3rd contract with o2 under this false name !

Point im getting at is that i have tried to get them to change my details several times, and they never have , ive been looking about and it seems that my contract is a bit crap compared to say the 3 network so i want out of o2 !

Spoke to o2 about ending early and they want the usuall remaing contract settlement but im starting to think now that they have to end the contract ??
Surely the contract is void between them and I as its not in my name ??   Im not really after any legal advice here lol just people,s oppinion,s .

Any ideas folks

soduum! cancel the direct debit, let them send you out a wee letter asking for the money and when it shows up, with the wrong name, simply write "not known at this address" on the envelope and pop it back in the postbox.

Anyway.

You don't say how wrong the wrong name is.  Spelling mistake or just different?

My first name is Mathew and they have me as Mark and there are 2 spelling mistakes in the surname !

Im not going to try and hide from it by cancelling the direct debit im just curious as to how i stand ?
Looking at that link you sent it would appear i dont have much of a leg to stand on :( either way ill ring them tomoroow and see what they are saying .

If I was you I would write them a letter. Point out how many times you have tried to sort this out in the past. Offer them one final attempt to sort it, or you will deem your contract void.  This will - if they value your business - hopefully get it sorted and perhaps a better tariff and phone.

I agree 3 are rubbish, and the fact that you have been paying them for years will be seen as proof of an existing contract.

i left 3 last year, they are crap.
