Title: Can a Stealer do this to me???

Put a deposit on a 59 plate fiesta Zetec on saturday at my local Ford dealers, had seen a fiesta at there swindon branch that the Mrs wanted. Anyway got a phone call tonight from the Manager saying they had got the price wrong and they won't sell it to me unless I give them another £500. Saw it advertised on Autotrader. Can they do this to me, he say's they do not have to sell it to me at that price if they don't want to. Should I go to Trading Standards?  :angry: :angry: :angry:

I think they don't have to sell it at the lower price, if they don't want to.

Will they give you your deposit back?

Bast4rds, yes deposit back but I will have to wait as the manager is now away for 2 days. I hate dealers  :angry:

yes they can, but they will have to give your deposit back as they have changed the terms of the agreement

however... you can use this as a bargaining tool should you decide to buy something else off them for the inconvenience caused and because, if you find one there that you like, it 'won't be the one that you really wanted' will it?  :wink:

or else... get sh!tty with them and demand your money back and go and buy elsewhere

no, sorry... if they have changed the deal then you are entitled to your money back, if you want it, immediately.

If she really wants it then kick up a fuss with manager did you sign any papers stating the car is in your name as of yet?
I think there is a clause stating that if they sell you something at a price, with agreed terms, they are obligated to full fill the good faith of purchsing. The only issue is if you take the deposit back you have no leg to stand on afterwards as you have agreed to terminate the deal?
The only other option is to get the same value or spec for the same money if the car in question doesn't not exist anymore?

It's at Allen Ford Swindon, but paid the deposit to Allen Ford Northampton and they were getting the car upto me here. They recon that the car was missing the VAT off the price on the internet.  :angry:

Part of the consumer act states that when money changes hands that's when the price becomes firm, they can charge you a completely different price at the till than what's advertised on the shelf unless money changes hands over an agreed amount. Or at least that's what I've gathered from the "Invitation to treat" and "Offec and Acceptance" parts of the consumer protection act.

Bent as fook the lot of them.. Missus got scummed, next door neighbour just went through a really bad experience with them... they have thousands of complaints against them...  If I need to expand on this with reasons, ask.

They are all dodgy as f4ck or they would have proper jobs, put them in the same league as estate agents now. Got me money back, sat in the office and said till you give me my deposit anyone that walks in I would tell them what a bunch of sharks they are, soon got the card machine out  :grin:

It is an old skool myth they have to sell it to you at price listed/marked up. In some cases they sell it before realising then it is too late but until money has changed hands they are well within their rights.

I think some folk are confused here - they don't have to sell the car at an advertised price but they do have to honour a contract that has already been acted on.

Money has exchanged hands - a deposit has been paid - I believe at that point the contract is agreed.

Avoid all Stealers in Swindon, Simular happend to me a couple of weeks ago.

I went to swindon motor park, as they were advertising a Sharan tdi sport on a 51 plate for £2500
We agreed £2200 if they mot's & gave an oil change
I put £99 deposit

4 days later they called me & said that the MOT work needed was too expensive and could not sell me the car.

Or if i wanted the MOT work done, thay wanted another £1200

So I told them to get fckd and give me my £99 back.

Personally I think they knew they had another buyer to pay more

So i was peed off & bought the mk5 gti instead  :laugh:
