man im so pi$$ed off, it finally happened today, the dreaded letter come through the post claiming i was doing 38 in a 30 caught by what appears to be a mobile.

it says                  preston road 30mph (NW), ribchester (E DIV) mobile

now the story

this is how i remember it, and have only 1 thing to prove it wasnt me, my log book where i wrote his name as the driver for that day..

I work for currys as a pc field engineer / delivery driver  and i was out with a work mate (no longer) and unbeknown to either of us we must of run this camera.
this was the 18/3/11.
We never heard anything about it, and we werent expecting it as wwe didnt know etc, then the day before the 28day to notify the police who was driving i got a call off my mate telling me bout it and he asked what my book says, he says he wasnt driving, so i said well your down in mine as driving, sorry mate all yours, kinda thing
so when i get back to work, the boss dealing with this says shows me your book, and it shows he was driving, but.. ive being filling it in wrong since i started (never shown how to, as per usual) and ive written drive times down with his name next to em, so he says well i see what youve done, but cos youve put times down, to me you were driving,
i was like wtf, you can see all through the book what ive done, and he just goes on about doing it wrong, which is fair, i have, point being i have him down as driving.

I phoned him later after and he said well sort in the morning, so fair enough, but morning comes, and no sooner were we in but i see him driving off, making no effort to look at me or talk to me etc.  So i go in complaining, and there were all the bosses there and said look hes gone and not sorted it, to me thats an admission of guilt, if some one accused me of somet i aint done, id be like gtfooh, and play hell, but he just buggers off. 
And since he hasnt spoke to me or acknoledged me,  a couple of times the boss has said have we sorted it, and i have said no, and hes promised to get us in meetings and stuff etc, this is 3months in the making virtually now, and still no resolution.

3 weeks ago this came up again, so i said you get the pic and if its me, ill take em, if not, sort my ex mate out etc

So 2 weeks ago we were ment to have this meeting, and on my last day in, the boss says to me, whats your dob, so i say why, and he says for the ticket, so i say wheres the pic, and he sheepishly says, its from the rear, so cant id driver, and tells me the police are now investigating it and will wanna speak to us, but obviously a lie cos today i get the letter about it.

now it appears to be a mobile camera, so ive looked and ive not found any that are rewards, they appear to be front on all the time, so just wondering if anyone knows different?

im calling tommorrow between 10-2 as thats all they are open, lancashire constabulary for this thing, to try and get a pic, but i have read on the internet on forums i may have to pay, which i will, but i dont want it to take ages cos after 4 months i will not get the course, (as i am clean licenced, hopefully 3 years, there was somet a long while back)

so i dont know what to do, if i thought it was me id roll over and take the slap, but as i dont think it is, im pi$$ed off about it.

i will be writing to hr about the way ive being treated thou, cos this guy is not a good boss by any means, and no support at all..

what woud people suggest...

Request the picture. If you were not driving, its not your problem..

It's down to your boss to provide the drivers details which he must do by law. However, he can argue that their are two possible drivers and request proof (i.e picture) to enable him to provide the correct details. Your boss cannot provide your details if he is not sure it's you who was driving. Argue the case with your boss first and then if he does send your details then argue the case with the Police and ask for proof of them. The case must be concrete to be stuck to you Mate.

Yeah I know, I just wanna make sure I do the right things, cos don't have much time, wud u say that from this it means it was mobile camera? And do they take head on only?

Requesting pic tommorrow, but it says on the letter they may not supply it!

If there is any doubt between 2 drivers they have to send a picture if there is one. If there is no picture then they cannot pin it on you.

Cheers, like I said he sheepishly said it was rearward camera pic,  very quietly and cudnt show it me! Think he was lying Cos under pressure and picked me cos I didnt stand up to him!
I got letter today, so will be calling tommorrow for the pic! Hopefully (fingers crossed)

I spoke to the police centre yesterday and she was really helpfull.

Said pic is reward so no faces, but said shell try and get the image enhanced where wing mirrors are,! Bit of waking the dead style work :) and send it me if anything comes of it..

But kinda resolved today, as the other lad last night told a mutual work mate he'd take the points if I pay the fine, so I agreed and got him to bring his letter in to work today, we filled em in and I got both and sent em recorded. So hopefully that's the last of it, 60quid down but no points so kind of a good result! :)

Thanks for advice, and pms from chuff, fortunately I didn't need to action them.

He's willing to take the points so that suggests he KNOWS and is effectively owning up to having been the driver. Oh well, your money not mine :tongue:

Spot on mate! I know that, but 60quid and it's done, and also work threatened to put us both through discilplinaries for failing to own up to a offence so it makes sense to get shut of it. Maybe if I had being there and recorded him saying it, I could of challenged it in court, but I've had a gut ful of it for the last 14weeks so I'm glad it's resolved and doesn't affect my ins or anything, just a few less beers on holiday..

dont argue at this point, call the caourt tell u moved house ot sh!t.. didnt realise till now, i just had a baliff here last sat for a speeding tickit las yr.... £280!!!

get in touch with the court!! plead blonde, and ask for installments x

lol, i understand what ur getting at, but as mentioned, sorted now as best as it could of being, time was ticking and things were getting to much, but thanks for ur posts.

Have just read your post and before you made your own decision, I would have suggested that you get a new job as your boss sounds like a thingy and just wants as little issues as possible.

Nothing wrong with paying someone else's fine for them if you want to, but personally I think that was a bad move. Should have stood up to your boss more.

my boss is a sh!tbrick aswell, im leaving next week, i might snap the key off in the ignition  :rolleyes:
