I've just received a £40 fine for not redeclaring the SORN on my 'spares' Audi. I had a SORN on it that expired in February however the SORN quite clearly says I will receive a reminder after 12 months to redeclare the SORN. I did not receive the reminder (bare in mind I have 4 cars SORN'd and I was relying on the reminder to redeclare them). I don't see why I should pay a £40 fine when they haven't sent me a reminder and the car, that is undriveable anyway, has been sat where it has in my garden for over a year.
Anyone know where I stand here? My first thought was to ring them but all you get is an automated response that doesn't allow you to talk to anyone. So my next step is to write and explain why I didn't redeclare the SORN and obviously at the same time redeclare it now that they have reminded me.

oo..not sure hun..but ill b sure to keep an eye on mine if they arent sendin any reminders?!any way to get money out of ya..tis well shockin hun..

im not to sure, i think there stance on it is that they don't have a duty to remind you, like with your car tax, and that if you forget its your own fault......sorry dude

Really pisses me off as they definately didn't send me one. I had it in the back of my mind that one of them must have been due by now, so I was keeping my eye on the post :angry:

They tried to pin me for something like this a few years bk. Seeing as i had done nothing wrong, issue was resolved, they apologised.
Appeal against it, you should get somewhere.
Seems the gonvernment has now turned to use the DVLA as its latest cash machine after speed cameras

I have until the 30th April to pay the fine and arrears. A letter will be fired off tonight asking why I was not sent a reminder and why my first notification of the fact that it is due, is this fine and payment of arrears. Obviously I will send another SORN decleration as I will treat this as a reminder.
I'll let you know how I get on. Treat this as a 'heads-up' everyone that has a car SRON'd! Don't rely on the DVLA to send out a reminder!
I've now got some floorboards to lay so the hammer is coming out and each nail is a member of the DVLA and will be driven into the wood in one blow :angry:

Hope it all gets resolved rich, and watch that your thumbs dont become a member of the DVLA, as that will hurt lol

Hope it gets resolved but you might want to pay it before that date and try to claim the money back.
I had a simular tax problem with the DVLA and once it went passed the deadline, it went up and up ended up paying £160  :angry:
All there new silly rules, having to pay for log books etc...... all money making cr*p!

I agree, all this stealth taxing is really starting to get beyond a joke.
As it is I've just had to pay a £60 speeding fine! Unwittingly overtook an unmarked car on the finished section of the M25 just before the M3. 40 mph is so slow when you're practically the only vehicle on a 5 lane motorway at 2.30am........so difficult to keep under 40mph! But fair enough, I was over the speed limit so my bad.
But this really gripes me as does the fact that I have just had to fork out £19 for the Polo log book as the previous owner had lost it........you never used to have to pay :angry:
I've got until the 30th so if I fire off a letter tonight then hopefully I will get a reply before I need to send payment. Obviously if I don't hear in time I'll forward payment in order to prevent incurring further penalties.

Mine was cuase I sold our bus and he didn't tax it! I did send off the log book but they said they never had it, so I had to pay!! Even though I then wrote in with a copy of a recipt with new owner details on.

silly stuff!!!! They should be spending more time on the people who should be paying there tax who have cars on the road! You used to be able to backdate and sign a decleration to say the car was not on a public road inbetween dates it is all getting a bit silly!

surely there breaking the law themselves if they send a fine because they havent sent or you havent received the v11 surely then a threat should be issued first and no jump the gun with a fine. if you owe money or forget to pay a bill they send a reminder its there legal obligation if you ignore that reminder then they issue threats and take more severe action not oh sorry we didnt send you the form heres your fine thank you have a nice day.

You know what, the more I think about this the more pissed off I'm getting :angry:
I've held a full driving license since 1984, 21 years! I have never driven an untaxed vehicle on the road. I know of at least 3 locals in my pub who drive there with untaxed vehicles and yet its me that is being hit :angry: They've been doing it for as long as I've been going down there (thats a long time :wink:)
I think I'm going to take this head-on by CC'ing the letter to the DVLA to my local MP and the driving associations.

I would say there was a fairly good chance you would win if this went in front of a judge they would have to prove they sent it against your saying you didnt receive it and knowing the amount of fk ups DVLA and the PO make you may just win.

if you want to get more p*ssed off, they latest idea is to charge an admin fee for doing the sorn, apparently if they do it it will be around £10, but they will be able to raise it at any time once the rule is passed.
so basically the ***** ******* ******** ******* ****** and the farmer who's donkey it was, are planning to charge us just for having the car even if it is in peices :angry: :angry: :angry:

Carrie, I've been pissed off about this all day..........and you're not making me feel any better :angry:
Whats even more annoying is I recently had to move the car from my father in laws to my place so I hired a trailor and borrowed my Dads car to tow it. Wish I'd bloody driven it now..........at least I wouldn't begrudge paying the fine if caught. This I seriously do begrudge :angry: :angry:

Ohh, I sympathise with you Rich. Remember my post about the sorn on my motorbike?. Fought with them tooth and nail, didn't get me anywhere as it is your responsibility :angry:. I thought this system was put in place to stop people from using untaxed cars on the road, the element of society that they should be catching do not register the car in there name!. How can they think of admin charges as aren't we are already paying there wages?. Are these people civil servants? (or tax collectors), if so should they help us or advise us as to the best course of action?. Just another tax on the shoulders of the honest man.
(Thinking of forming my own government :angry:)

I'll send them a snotty letter and then, from what I've seen of other peoples experiences, I guess I'll end up paying..........you live and learn, put it down to experience.
If I take anything from this it will be that I hope everyone on here has seen what has happened to me and will have learnt from it. I don't want to hear the same thing happening to anyone else :wink:

Well actually its £67.50 because I have to pay £27.50 back duty even though the car has been sat in my garden since the SORN expired.
Not as bad as £200 I'll give you........to be honest its not about the money, its the more the principle of the matter.

Exactly. There are a couple of 'friends' of mine who have been using their cars for around 3 years with no tax, insurance or MOT, in fact one is even banned from driving. They drive down the local regularly and always seem to get away with it. How does that make me feel. Makes me wonder why I bother. Anyway I'm chilled now, not going to upset myself again.......where's that Stella :smiley:

Don't think it hasn't crossed my mind. And it does worry me that something could happen to an innocent person or people. But I really can't bring myself to grass on anyone. At the end of the day isn't that what our police force is supposed to be doing: enforcing the law? This is another can of worms I don't really want to open right now as I know how strongly some people do feel about this issue.

I've had a similar problem but it was resolved. I shall explain!
In 2002 I bought an MG Metro sport as I had nuked the engine in the mini at a track day and the Metro Sport has an MG Metro lump, just what I needed! I ranit as my car for a couple of months as the mini needed some other work first. Eventually the Metro was taken off the road and stripped. The engine stripped, tuned and dropped inthe mini, the rest of the usuable parts flogged on ebay and the vehicle declared SORN. in around August the remains of the shell was picked up and scrapped. I forgot to send the V5 back stating it had been scrapped until the new one arrived shortly before Christmas so I sent that one back with "SCRAPPED" written in big letters across it.
Just after CHristmas I recieved a letter saying the Sorn had expired and that I owed the £60 fine and some tax arrears of around £30. I wrote back explaining that the vehicle had been scrapped before the SORN had expired but I also included a cheque for the fine etc as I didn't want it being increased for late payment.
A week later I got a letter back saying that the matter would be dropped and they included my cheque so I could destroy it.
Guess I was just lucky!

dont work joe, comming home from the pub with my sister one night and this guy mounts the kerb completely nearly hitting my sisters boyfriend (he had to jump out the way), the car was weaving all over the road. called the police and their response was "we cant just go round stopping people cause you think they are drunk and its not a priority for them" naturally words were said by me to them and their response was if i swore at them again they would come round and nick me.
3 witnesses to whats happened, my sisters bf nearly getting killed and a driver who is obviously drunk, and all they cared about was my "attitude" to their response of we cant be bothered.
what do we pay the police for? i have forgotten

gotta say that is a real sh*t mate..............i had a car that i dint declare off the road just after they brought the statuatory fines in but was lucky enough to tax it before gettin a fine.....but i dont think you'll win this one!! the law states that it is your obligation to to declare it off road. Another sh*tty little revenue earner!!! at least Gatso's give ya some warnin of a fine.

similar thing just happened to me, we have a couple of old scrappies lying about that we just havnt scrapped yet and they didnt send us a reminder now we gettin the fines. Also just received a letter from dvla with them asking me for more money for my road tax. Back when i bought it they didnt send me a reminder but fortunately i remembered. So at the local post office they calculated the tax off the log book. Turns out they made an error and i owe an extra 30 quid. The nasty letters i received are ridiculous! I mean I had the money at the time if someone hadnt screwed up but at the moment im out of a job and tryna save the money that i have for inters. Bastards

i didnt know that you had to renew the SORN every year!! my cars been SORN for over 2 years while its being sorted and i havent had any reminders/fines. might have to look into it as i wanna get it back on the road next month and i dont want any nasty shocks!!. :sad:

I have sent off a SORN form and have paid the fines. I have also fired off this letter to them:-
Ref: D260 JAH
Dear Mrs P Woolley,
You have recently fined me £40 plus £27.50 back-duty for failure to renew my SORN on vehicle: Audi 80, D260 JAH. I have enclosed a copy of this letter.
In a separate correspondence, I have paid the fines and filled in a SORN, as I do accept that is my responsibility to ensure that the SORN is renewed. I am, however, extremely annoyed that the first notification that I have received from you is the fine and back duty. No reminder was sent. It quite clearly states on my SORN that a reminder will be issued. I have enclosed a copy with this highlighted. Because of this statement I was led into a false sense of security in thinking that I would receive a reminder and could then renew the SORN in due course. As I hadnÂ’t marked it on the calendar (I didnÂ’t think there was any need as I thought I would receive a reminder) the SORN was allowed to expire.
I think it is wrong to put this statement on the SORN if there is a chance that you may not issue a reminder, as you are misleading people. I understand that this not an isolated case and fully intend to visit CAB and my solicitor for further advice.
As said, I have paid the fines and filled in the SORN in order to prevent further fines and unnecessary costs: basically I have regarded the letter as my reminder.
IÂ’m a law abiding person who has never driven an untaxed vehicle on the road so feel aggrieved that you have targeted me in this way. I fully agree with removing untaxed vehicles and drivers off the road but this appears to be merely a money raising exercise from unsuspecting law abiding people.
IÂ’d appreciate it if you can give this matter due consideration and as stated I will be seeking advice to see if I have any grounds for claiming my money back.

Rich, you've paid up and also told them of your annoyance so I think that's fairly put and it's always the case that the government etc will always track down and fine people like you/us because we are the people who will pay the fines etc. :angry:

you might get a letter with an apology, depending on who opens the letter, or they'll just say that the fine has been received and that will be that and they gloss over your grumblings....
