I was involved in an accident of Thursday last week at around 11pm, my Golf and a Mondeo. Was driving down a one way street in the left hand lane, said street has three lanes. There was parked traffic in the lane so I indicated and checked my mirrors, nothing coming. I moved into the middle lane and collided with a Mondeo. I parked up and spoke to the driver. He took my registration number and mobile number, I forget to get his registration, then he left really quickly saying he needed to get to work, he might or might not ring me!
However looking back on it, I can't prove where he was on the road. He could have been in the middle lane, or he could have been in the right hand lane and also moving into the middle lane. The right hand lane also had parked traffic blocking it. I'm beginning to believe it could actually be more of a 50/50 split in terms of liability, as there's no proof other than we both collided in the middle lane.
Anyway, I finally heard back off the other driver today via text message.
On Thursday 14 April you hit my car. I'm ready to talk. How much you can pay for it?
To which I replied:
Hi, we need to swap insurance details, I'm not using cash for anything.
He replies with:
Ok. If you haven't £250 for new polishing you send your details insurance policy and your own details.
To which I reply:
You have my registration number. Pass me your registration number and I'll pass it onto my insurer, I've got to have the information.
His response:
Sorry! You hit in my car. you should given for me your details. Not I for you!
I reply:
I need your details to pass on to the insurer. It's illegal for me not to tell them. if you disagree then please feel free to ring the police to confirm this.
He hasn't replied or said anything since.
Where do you think I stand? I have a feeling he isn't insured. He was in a hurry to leave after the accident and won't give me his details. It shouldn't matter but he's foreign, my guess is Polish, but I'm no expert. Also, in terms of the accident, would I be correct in saying that it could be classed as a 50/50 accident as it's two cars colliding in a middle lane? I've no intention of using my insurance to fix the Golf, going to sort it out myself.

Here is what I'd do, mate:
- Text him your registration and insurance details again so that you have proof that you provided them.
- Inform the police that you were involved in an accident with another car. You stopped to provide your details, but the other driver left the scene without providing anything more than a mobile number.
- Get your car fixed up out of your own pocket if you want to avoid a claim.
- Ignore the other guy. You have provided him with all of the information that you are required to by law. If he is uninsured (which I suspect he is), he will not claim. If he is insured, you can deal with that when and if he makes a claim.
That should cover you.

just go about fixing your golf.. he has your number if he wants to take it further.. you done right by giving your details.. so he cant say its hit and run or pull out any crap.. SAVE THE TEXTS THO proof :wink:

Well I rung the police and reported the incident, I also mentioned he didn't give me his registration number, and was refused to whilst we've conversed. Ball's in his court now. Still no reply from him.

Best thing to do mate, you have the evidence!
I had a similar thing, woman driving on L plates no one with her, hit my car and drove off just leaving a note, her husband took the fall in the end! but evidence is everything!

yeah sounds like he was trying to scam you for some money. he sounds like he s uninsured, just report him to the police.

Have you informed you insurers yet? Even if you don't intend to make a claim you may need there legal assistance. I would never have given that solicitor any information other than your insurers details, did you check them out afterwards? They may even take the fact that you said you was in an accident as accepting the blame. I wouldn't be surprised that you receive a claims/court summons now.
Just redirect everything to you insurers it's what they are there for. I would imagine this going 50/50.
