So heres the scenario , your a hard working everyday lad, whos car has dropped a valve and needs a new head, you come onto this website, and see a regular trader has one for sale , lets just say this one ... http://www.golfgtiforum.co.uk/index.php?topic=174903.0       you ask the relevant questions, he assures you its as is, so you pay the full asking price no problem ..... you ask if he can provide proof of purchase in the form of a written receipt, along with a signed agreement that if the customers head specialist is not happy with the condition of the head it will be taken back  (however you dont think you will have to do this as the person has said hes being honest and the head is as described).

then say theres no reply to this... not until 2 days later when you ask if the head has been sent, and he replys "yes",    head turns up, now going on the description from the above ad, there is a fairly large semi circle score when piston number 2 has hit the head, but machining has not produced a true flat surface,   secondly there are no new valves in the head, just old ones that have been cleaned up with emery cloth, and thirdly, no proof of purchase or receipt as agreed,  you contact the person to tell them , firstly the head is not serviceable, or as described, you even give them the number for your head specialist and garage for them to speak to , and they say they will, and then hear nothing,  only to be told to f*ck off in an email ...... 


what would you do? , now £330 out of pocket, with a non useable head, and someone who obviously has no morals or decency to admit they wer wrong?


small claims court?, trading standards?


please help, this forum is designed to help and i think i have a good reason to be helped

If everything is, exactly as you've described, then I would want my money back! diplomacy should come first however, and maybe contacting one of the relevant mods, to discuss the problem, may have been a better idea, before posting...

Firstly.

You can show that by sending the head he has agreed to your terms on returning it if of unsatisfactory condition.  Was this be email or phone?

Did you pay by cash? Absence of a receipt may be your undoing if you have no way of proving purchase - unless you have lots of email traffic to substantiate a purchase. If you also have the original advent with pics and obviously you are in possession of the head - so much the better.

Secondly.

If item is not as described as well as a breach of the first point then Small Claims Court is the way forward.

Inform him of your intention to sue and let him stew.

If he doesn't refund in 14 days take him to court.

if you have no receipt, the way you paid might save your arse, i assume you prob paid over the phone as he gave you a mob number so you prob paid by card, i would have thought you could use this as a proof of purchase. try once more contact him via phone and email, print off any contact you had with him over email, print off that original ad thread and take him to court if you get nowhere. contact your local citzens advice they'll be able to let you know legally where you stand with this.

it might be worth contacting someone like J.V aswell, as he may know a bit more about this company, and prob would have them removed from the site.

i had a simalar dealings with an ebay seller with a transit head but the cam bearinges were ripped up and unservicable i just got told to f**k off repeatedly.  i will no longer buy used engine patrs over the internet as they are so rarely as described and often to much bother to sort out

but alarm bells should have being ringing realy when you look at the work clamed to have been done and compared it to the price.  as it was advertided on the forum i would get some pics up and slate away if its as bad as clamed

Just had a head freshly rebuilt for customer and theyre not having it now.

Small port 1.8 20v Turbo Head

* Decoke
* 20 new valves
* New valve stems
* Valve grind
* Skim

Work done totals £350 + valves, then head price.

All im asking is £320

This head is essentially brand new and ready to drop on an 058/06A block.

Collect or i'll courier it

Well the advert says new valves so I would think in one way or another you have a claim against the seller.

write to the seller tell him why your not happy ask if hes prepared to come to an amicable settlement if not go to small claims, i  had a similar problem last year took small claims action as soon as they got the court forms they settled

You don't want an "amicable settlement" you want a full refund.

I'm not near a PC to give to step by step guidance with the benefit of my LLB but the crux is that he is a trader and the item was not as described. You win every time.

If I was a trader on this site, looking to screw my reputation this is exactly the course of action I'd take.

Conveniently all of his contact details are on his website, so you know exactly where to send the summons etc to.

If you have no comms with him then that's your only option, really.

Personally from the point he sent you an email telling you to f**k off says it all,I would be knocking  his door very hard its easy to ignore you and tell you to f**k off but when your face to face its a different ball game.Alot of the time these types of people or companys call your bluff and try there luck and in some cases it works as some people dont know really what to do.Its clear to see he has no intention of giving you your money back so why waste time with small claims court which still dont guarantee  you will get your money back or how long it will take.Take your son and some lads with you if you can and land there see what he has to say then take the head with you and dont let him know your coming I just think the longer you leave it the less chance you will see your money mate if he still dont want to refund you well I know what I would do but maybe then try the claims court best of luck mate.

No well see i dont have the receipt, i have mesages i sent him asking for one to be sent and he didnt send it, i have the original advert, i have emails asking for the head, and texts confirming payment, i paid via bank transfer, so have proof of that too,   to be honest, hes in business its not a huge amount of money to him, but it is to me, why cant he just do the right thing and give me a refund, ive been perfectly honest and helpful with him, paying straight away etc etc, and hes sold me something that really no better than the scrap head i had previously,

i wouldnt normally do this and write about it, but after he sent me that emai i was enraged, and felt you huys should know whats happend 

thankyou for your help and advice, proves there are good people out there!

is quite clear that he is a scum bag!!!! ive been had before and feels horrible!!! if i was in that situation i would be straight round there, despite the milage and demand my money back!!!  i bet you if you were to turn up, he would sh!t a brick and give it straight back!!! all the best mate!!!!! :grin:

I bought some pollybushed lower arms off this chap and they were knackered too !
However he did eventually give me my money back albeit minus what it cost him in delivery  :angry:
Seemed like a genuine bloke and with the amount of trade he does on here I was expecting better.

Can't figure him out really as he must do well out of this and other forums so can't get why he's sending out parts that arent fit for use ?

Anyway I hope you get your money back matey either through a refund or as others have suggested through small claims or a visit :)

yeh thats what i cant understand, to be honest if he had done a refund, then i would have thought ok fair enough atleast hes true to his word!    its such a long way to york this is the problem,  but im not giving up until he gives me a refund!,  small claims court itll be, ive emailed him saying that i want this refunded or else,  ive even said ill pay the carriage!

ADMIN NEED TO TAKE SOME COURSE OF ACTION!!! THIS IS NOT ON. admin know there ip address and can trace them. (ok not that simple) but you get my drift! there are innocent people out there getting bummed over. & WHY THE HELL DO YOU THINK YOU NEED TO PAY FOR CARRIAGE CHARGES??? he advertised something with false details and now your going to pay to take his sh!t back to him? I hope you can appreciate that the forum is stuck in the middle so to speak and the matter needs to be dealt with between the OP and the trader.

And off we go.

I am 110% JV and the rest of the Admin team are addressing this issue.

Just cos people are forum traders, and pay towards the upkeep of the site I know that if they are " fleecing" the members then action will be taken as per

Well how a situation gets dramatised to the maximum......... Read first post then replied, don't need to read anything else

Im not addressing any points via the forum or text/email as the buyer as lied about quite a few points of the sale, i have better things to do with my time than correct the ever ending lies that people give me.

My contact details are evident everywhere, Surely phoning me would of course be the most direct contact rather than being a drama queen and trying to get attention?

he said he contacted u and u told him to fooook off, it would be better if you told your side instead of saying ur not replying threw forum etc as people will judge you for this.......just my opinion iam going to rub vasaline into my stiff nipples now hope all is sorted out soon lads....peace
