what do you do in this scenario....advice needed
« on: 30 October 2014, 12:47 »
My missus was driving my car, me as a passenger. We were waiting at an exit of a petrol station and there were three cars, all waiting to turn right. we were the third car back. For a reason unbeknown to anyone but the driver the car infront of us decided he wanted to go left instead so he reversed right into the front of my car, the front driver drove off (probably not seeing what happened) the wing is crushed/dented and the bumper scratched/torn apart. After getting out and speaking to the driver he said 'why would I reverse, you drove into me!' no witnesses, apparently no CCTV (funnily enough he works at the petrol station)

now my missus is third party on her insurance to drive other cars and not a named driver on my policy.

Damage to his car consists of a small dent in his bumper, mine as above.

The police came and exchanged details because he was about to leave the scene of the accident before I 'advised' him not to.

if his rear light cluster smashed , there should be proof his reverse lights were on as glass will melt to the filament. (long shot though but all i can think of)

If there are no witnesses and no CCTV and it his your word against his, the best case scenario would usually be 50/50

The fact it is under the third party only driving makes it worse for you as well because you will probably have to repair your own car, not good news I know but that is how it goes 9/10.

Sorry to hear about your situation!!

Hope you get it sorted and you are the lucky one!

Well we have just been checking the CCTV at work and it did pick it up (just) the cars were far enough back to just get caught and you can it all. Now the image isn't crystal clear but you can make out what has happened so hopefully that will be enough for his insurance company to admit we were not at fault.
